STIPULATION N0. 3 <br />WITH 180 DAYS OF <br />THE APPROPRIATE <br />APPLICABLE WATER <br />THE MINE. <br />PERMIT ISSUANCE THE OPERATOR SHALL PROVIDE DOCUMENTATION <br />FILINGS HAVE BEEN MADE WITH THE STATE ENGINEERS OFFICE OR <br />COURT REGARDING THE STORAGE AND CONSUMPTIVE USE OF WATER <br />THAT <br />AT <br />Status - Not in Compliance <br />The Mined Land Reclamation Division (MLRD) files do not contain information <br />concerning water rights for consumptive use of mine water by the Southfield <br />Mine. Appropriate information satisfying this stipulation must be submitted <br />and inserted into the permit application. <br />STIPULATION N0. 4 <br />WITH RESPECT TO THAT PORTION OF THE COAL LOAD-OUT LOCATED WEST OF THE COUNTY <br />ROAD 19 IDENTIFIED A5 AN ALLUVIAL VALLEY FLOOR, WITHIN TWO YEARS AFTER THE <br />COMMENCEMENT OF THE PERIOD OF EXTENDED LIABILITY AS SPECIFIED IN RULE <br />4.15.7(5) THE OPERATOR SHALL COMPARE THE SOIL CHARACTERISTICS OF THE RECLAIMED <br />AREA WITH AN ADJACENT UNDISTURBED AREA. THIS COMPARISON SHALL BE SUFFICIENT <br />TO VERIFY THAT THE INFILTRATION, PERMEABILITY, AND TEXTURAL CHARACTERISTICS OF <br />THE RECLAIMED SOILS HAVE BEEN RE-ESTABLISHED SUFFICIENTLY TO RENDER THE AREA <br />AS POTENTIALLY FLOOD IRRIGABLE. <br />Status - In Compliance, Future Submittal <br />Resolution of this stipulation is due after closure of the coal load-out. <br />STIPULATION N0. 5 <br />THE OPERATOR SHALL MONITOR THE WATER LEVELS MONTHLY IN THE THOMPSON WELL WATER <br />SOURCE BEGINNING 120 DAYS PRIOR TO PILLARING OR SUBSIDING WITHIN 1500 FEET OF <br />THE THOMPSON WELL. THE OPERATOR MAY EITHER GBTAIN THE USE OF THE THOMPSON <br />WELL FOR MONITORING OR DRILL AN ADDITIONAL WELL COMPLETED IN THE SAME GEOLOGIC <br />UNIT. <br />Status - In Compliance <br />This well is no longer serviceable and samples can not be obtained. <br />STIPULATION NO. 6 <br />THE APPLICANT WILL SUBMIT TO THE DIVISION AN ANNUAL REPORT OF INFLOWS, <br />DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS REPORT IS TO <br />INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF INFLOWS: A <br />TABLE KEYED TO THE MINE MAP WHICH SHALL CONTAIN THE SOURCE (i. e., FAULT, <br />FRACTURES, ETC.), QUANTITY, DURATION AND QUALITY (i.e., pH, <br />ELECTRO-CONDUCTIVITY AND TEMPERATURE) OF ALL INFLOWS: A TABLE CONTAINING <br />-5- <br />
