with the predicted subsidence in the permit application. This comparison <br />should consider both the magnitude and nature of observed subsidence as <br />well as the predicted secondary consequences of subsidence such as impact <br />to structures and renewable resource lands. Non-compliance in this <br />portion of the permit application is addressed in more detail in the <br />enclosed enforcement memo. Compliance deadlines will be set in the <br />notice of violation. <br />The City of Florence water pipeline has been identified in the permit <br />application as being potentially impacted by subsidence. In the permit <br />application the Southfield Mine committed to "monitor the pipeline for <br />possible impacts from subsidence, to maintain on site replacement pipe in <br />the event of breakage and to work closely with the Florence authorities <br />in all aspects of the above monitoring and repair obligations." In the <br />technical revision for an incidental boundary drainage for 40 acres <br />approved in December, 1986 the Southfield Mine requested not to maintain <br />extra pipeline for repair on site. The Southfield Mine should submit the <br />City of Florence's concurrence to this change. The permit application <br />should be revised to reflect this change. <br />II. Status of Stipulations <br />STIPULATION N0. 1 <br />THE OPERATOR SHALL SUBMIT RIGHT OF ENTRY INFORMATION FOR THE FLORENCE CITY, <br />A.T. MASSEY, AND CORLEY PROPERTIES, WHERE SUBSIDENCE IS PROPOSED, 30 DAYS <br />PRIOR TO AFFECTING THESE LANDS. <br />Status - in Compliance, Ongoing <br />The Southfield Mine has been submitting right of entry information prior to <br />mining in these areas. Additional right of entry information will be needed <br />for those areas outlined in this stipulation prior to mining. <br />STIPULATION N0. 2 <br />THE OPERATOR SHALL CONTINUE ALL HYDROLOGIC MONITORING OUTLINED IN THE <br />APPLICATION AND THIS FINDINGS DOCUMENT UNTIL SUCH TIME rS THE DIVISION <br />APPP.OVES OF MODIFICATION OR CANCELLATION OF THE PROGRAM. <br />Status - Not in Compliance <br />Hydrologic monitoring as specified in the permit application and the findings <br />document has not been done. <br />-4- <br />
