Any future violation of the terms and conditions of this extension or your original
permit will result in an enforcement action, which can include a cease work order or
administrative penalties of up to $27,500 per day. This extension is for one year only and
all other conditions of the permit remain in full force and effect. This office will not grant
any further extensions of the existing permits beyond November 30, 2004. Therefore, if you
wish to continue mining within the Animas River beyond November 30, 2004, a new
application for an Individual Permit will be required. As stated in our letter of July 14,
2003, future permit applications for mining operations within the Animas River shall include
an analysis of the hydrologic regime and bedload supply of the Animas River, as well as the
sustainabiliry of the in-stream gravel operations. Please keep in mind that the standard tune
frame for the individual permit process review is a minimum of 90 to 120 days.
In addition, it appears that our files are lacking several important items of information
that were to be submitted over the years as a requirement of your permit. Please contact the
Durango Regulatory Office to set up a meeting to discuss this information. If you have any
questions, please contact Ms. Kara Hellige, at the Durango Regulatory Office, 278 Sawyer
Drive, Unit Nl, Durango Colorado 81301, or telephone 970-375-9452.
Sincerely,
Brooks
