26. The annual hydrologic report (AHR) covering the previous water <br />year for the McClane Canyon mine will be submitted no later than <br />February 1 each year <br />27. Sediment removed from the sediment pond may be used as a <br />topdressing or topsoil supplement pursuant to Rule 4.06.2(4)(a), <br />upon submittal of chemical and physical analyses demonstrating that <br />the material is equal to or more suitable for sustaining vegetation than <br />available topsoil or other plant growth media. Such demonstration <br />shall be based on a representative composite sample of the material <br />obtained from each pond cleanout episode. Required parameters will <br />include those listed in 4.06.2(4)(1), with the exception of thickness, <br />depth, coarse fragments, and areal extent. Analyses for selenium, <br />boron, nitrogen, and organic matter will be included in addition to <br />those listed. Pond cleanout material will not be placed in the topsoil <br />stockpile or used as final reclamation topdressing prior to obtaining <br />written approval from the Division. <br />28. Within six months of permit issuance and prior to any surface <br />disposal of coal mine waste, the permittee will identify the source of <br />an appropriate volume of suitable non-toxic, non-conbustible cover <br />material [o be placed over the graded refuse prior to [opsoiling, <br />pusuant [o Rule 4.10.4(5). Unless analyses are provided which <br />demonstrate a lesser cover thickness will allow for successful <br />reclamation, the plan will specify that a minimum cover thickness of <br />four feet will be placed on the graded refuse. <br />Also within six months of permit issuance, a detailed description of <br />any proposed coal mine waste disposal within abandoned workings <br />shall be provided, pursuant to Rule 2.05.3(9)(a) and (b). <br />Documentation of Mine Safery and Health Administration approval <br />of disposal within underground workings will need to be provided, <br />pursuant to Rule 4.11.3. <br />29.
