Therefore, if subsidence occurred <br />above the limited extraction mains of the Third North it did so <br />with a negative angle of draw. This would indicate that subsidence <br />of this sort would have no mechanical implications outside the <br />ribs. <br />Regarding the railroad track, please refer to my response dated <br />June 7, 1995 which included a May 24, 1995 memorandum from Jim <br />Pendleton. <br />You have requested that we identify all areas within the Basin <br />permit where subsidence has occurred with room and pillar <br />extraction in addition to information concerning water in the First <br />North Main. All the information we have concerning these subjects <br />is public information, as you are aware, and is available for your <br />or your agent's review and copying at our office. <br />Response to July 20. 1995 letter: <br />I respectfully suggest that we agree to disagree regarding whether <br />or not the foundation of your residence has moved. We have no <br />additional comments. <br />Response to August 12. 1995 letter: <br />You again have asked for resumes from Randy Price and Joseph <br />Dudash. I responded to this request by letter dated July 5, 1995, <br />a copy of which is enclosed. To reiterate, current resumes are not <br />available and I have not requested that they be generated in order <br />to satisfy your request. In addition, effective August 1, 1995 <br />Randy Price has left the employ of the coal program. <br />The State of Colorado has not given permission for Jim Pendleton or <br />any other state employee to appear as an expert or a witness in any <br />civil case. Further we have no interest in any such appearance and <br />will seek to avoid such. On the other hand, all the reports, <br />documents, correspondence which has been generated regarding the <br />Golden Eagle Mine is public information and available for the <br />public's use however they see fit. If you require certified copies <br />of any of these documents please let me know and we will gladly <br />provide them. These documents can be entered into record as <br />government documents, without the preparer introducing them. The <br />exemption for introduction of government documents is well settled <br />in civil procedures and is included in the hearsay exception. <br />
