Therefore, DMG would have no ability to enforce the <br />written agreement between Tatum and Basin concerning subsidence <br />monitoring of the Tatum property. Further, at no time did anyone <br />from DMG advise Basin that they did not have to perform subsidence <br />monitoring of your property. <br />Response to July 10. 1995 letter: <br />We have reviewed Mr. John Reins' June 30, 1995 memo to you. No new <br />issues were raised in this memo and we, therefore, have no <br />additional comments. <br />Response to Julv 12. 1995 letter: <br />In a number of your letters of the past few months you have <br />asserted that the Division has not been truthful and have chosen to <br />defame and slander DMG staff. The Division has been truthful on <br />all counts, and I take exception to your assertions and <br />disrespectful tone. I am aware that many of the answers we have <br />provided have not been the answers you wanted to hear. Indeed, one <br />of the most unpleasant parts of my job is giving people answers <br />which are different from what they want to hear. However, our job <br />is not to provide answers which are influenced by an individual's <br />wants and desires. Rather our job is to provide answers which are <br />truthful and based on the best knowledge and expertise which we <br />possess. I am confident that we have conducted ourselves in this <br />manner in all our dealings with you. In addition, I require that <br />you address any further correspondence to me or DMG staff in a <br />respectful manner, similar to what you expect from us. <br />Specifically, whether Berhan Keffelew's concern was raised due to <br />"people living nearby" or "workers nearby" is immaterial due to the <br />fact that neither Berhan nor any other DMG employee has the <br />jurisdiction to discuss noise abatement at the shaft installation <br />covered by TR-15. Berhan continues to recall that he was concerned <br />about people working nearby and that he discussed this concern with <br />Mr. Stuart Francone of Wyoming Fuel Company. We have adequately <br />addressed this issue and will not respond to any further questions <br />about it. <br />Response to July 13. 1995 letter and July 19. 1995 fax: <br />The subsidence monitoring data set for the Third North Entry <br />monument transect may document minimal subsidence. DMG required <br />the installation of seven monuments perpendicular to the Third <br />Entry mains in order to document the subsidence mechanics above the <br />mains. The data set Mr. Gerity references includes subsidence <br />monitoring of these seven monuments for a five year period. Two of <br />the monuments, #4 and #5, show possible vertical movements of <br />-0.21' and -0.47', respectively. Monuments #4 and #5 are the <br />center monuments, located well within the outer submain ribs. <br />Monuments #3 and #6, located approximately above the two outermost <br />
