Rider to Mining Permit <br />Page 2 <br />Stipulation No. 33 <br />Twentymile Coal Company will resolve all concerns of the BLM and Native <br />American Indians related to the rock art site 5RT345 prior to longwall <br />undermining of the site. This will include considerations of the site <br />as a Native American religious site. The mitigative measures may range <br />from photo documentation only to limited coal extraction to protect the <br />site from subsidence damage. All surveys and information will be <br />submitted to the Division as part of the confidential appendix. <br />Stipulation No. 34 <br />Twentymile Coal Company will complete archeological and cultural <br />resource surveys of all areas to be affected by surface disturbance or <br />subsidence within the new permit areas added by PR-02 (Southwest Mining <br />District). This information will be gathered and submitted to the <br />Division 60 days prior to mining in panels 7, 8, or 9 of the Southwest <br />Mining District. <br />Stipulation No. 35 <br />Twentymile Coal Company will submit to the Division the road monitoring <br />and repair plan developed in coordination with the Routt County <br />engineer 30 days prior to longwall undermining any portions of County <br />Road #27 or the adjacent Twentymile Sandstone cliffs. <br />Stipulation No. 36 <br />Twentymile Coal Company will submit to the Division the agreements with <br />the owners of all structures within the angle of draw associated with <br />panels 7, 8, and 9 of the Southwest Mining District. These agreements <br />will be submitted seven months prior to longwall undermining of those <br />structures. These structures are, but no limited to, the dwelling not <br />owned by TCC, the gas well, the telephone lines, the power lines, the <br />County Road #27, and the D.G.W. rail spur. <br />Stipulation No. 37 <br />Twentymile Coal Company will submit to the Division a copy of the <br />Federal Coal Lease for all federal coal to be mined in the Southwest <br />Mining District prior to any mining of same coal. <br />Stipulation No. 38 <br />Twentymile Coal Company will submit a technical revision or combination <br />of revisions within 60 days of permit renewal issuance (RN-02) <br />addressing the probable hydrologic consequences section of the Fish <br />Creek Tipple, the additional of an alluvial well on fish Creek, the <br />mapping of the post-mining land use for the Foidel Creek Mine and the <br />
