The second lowest bid was submitted by Kessler's Reclamation in the
amount of $84,598.00. Phil Kessler brought up the point that
Wagner Construction did not attend the entire pre-bid meeting and
asked the Division to make a determination to reject the low bid.
The Division currently holds roughly $80,000 for remaining
reclamation work at the Hawk's Nest Mine. Remaining work such as
hazardous waste disposal and maintenance work is necessary. If the
lowest bid submitted by Wagner Construction were rejected the
Division would have to either cancel the bid or remove necessary
items from the schedule. With the acceptance of the lowest bid,
the Division could preform all reclamation tasks as well as have
sufficient funds remaining for necessary work needed on site.
In summary, the Division did not insist that Wagner Construction
view the wells before he left the pre-bid meeting. The purpose of
showing the wells was for location and access issues. The Division
requests that you accept the low-bid for Wagner construction in the
amount of $62,109.00
Please contact me as soon as possible so the Division can act
appropriately in this matter. Thank you in advance for your help.
c:\hawk\940902
