The low bid was submitted by Wagner Construction in the <br />amount of $62,109.00. <br />The mandatory pre-site meeting and site showing was held on August <br />18,1994. Jay Wagner of Wagner construction attended the first part <br />of the pre-bid meeting. Jay Wagner indicated to my self (the <br />Project Manager) and Paul Krabacher (AML program) that he would <br />have to leave the meeting early. The Division stated that it will <br />be noted that he left early, but we made no indication that it <br />would be cause for rejection of the bid. <br />The pre-bid meeting started at 10:00 a.m. and concluded at 12:30 <br />p.m. Jay Wagner left the site at roughly 11:45 a.m. The area that <br />Jay Wagner missed during the pre-bid meeting was the location of <br />four (4) methane gas wells. The wells are located up difficult <br />terrain which was explained in the bid specifications. Prior to <br />departure of Wagner Construction, the Division indicated that the <br />road was difficult to access and may require some modifications by <br />the contractor. Once again, the Division made no indication to Jay <br />Wagner that leaving early would be a rejection of the bid. <br />On page one of the bid specifications, it is stated that "failure <br />to sign-in or to attend the entire meeting will be cause for <br />rejection of the bid." Missing that portion of the pre-bid meeting <br />was not a significant portion of the work to be viewed. The well <br />hole closure is very straight forward in the specifications, and <br />the only reason for viewing the wells was to show the contractors <br />the difficult terrain and access to the wells. Exhibit IC in the <br />bid document depicted the location of the wells. The majority of <br />the pre-bid meeting was held at the base of the mountain where the <br />wells were located, so the difficult terrain could be noted from <br />the pre-bid meeting location. <br />
