<br />the Bureau of Land Management as well as by the Division. On December 13, 1994, the Division <br />received a copy of a letter sent to Mr. Rick Mills of TCC from John Husband of the BLM dated <br />November 25, 1994 authorizing the mine to proceed with the approved mine plan in the SW <br />Mining District prior to the final reports being submitted, as all required field work had been <br />completed at that time. Therefore, Stipulation No. 33 was terminated effective December 13, <br />1994. <br />Stipulation No. 34 required TCC to submit a copy of their agreement with the owner of the mobile <br />home to the Division. Thus, Stipulation No. 34 was terminated on March 25, 1994. <br />Stipulation No. 35 required TCC to submit to the Division the road monitoring and repair plan for <br />that section of County Road No. 27 which was to be undermined and subsided as a result of PR- <br />02, SW Mining District. On March 25, 1994 the operator submitted a copy of the Special Use <br />Permit issued to Twentymile Coal by Routt Counry. Specific monitoring and repair plans were <br />included in this amendment of the existing permit and included plans for the Eastern Mining <br />District as well. Thus, this stipulation was terminated on March 25, 1994 <br />Stipulation No. 36 required TCC to submit to the Division any agreements with the owners of any <br />structures to be undermined as a result of mining in Panels 7, 8 and 9 of the Southwest Mining <br />District. The rail spur was not undermined and the gas well was owned by Cyprus Western Coal <br />Company and abandoned as per MSHA regulations. On March 25, 1994, TCC submitted to the <br />Division a recorded memorandum of a finalized agreement with Mr. Robert Perry, the owner of <br />the mobile home concerning subsidence of same. Mr. Perry was relocated to a nearby property <br />outside of the affected area. Other structures were covered under approved subsidence control <br />plans (telephone line, powerline) or handled by other previous stipulations (County Road No. 27). <br />Therefore, this stipulation was terminated on March 25, 1994. <br />Stipulation No. 37 required TCC to submit appropriate right of entry for the Federal coal in the <br />Southwest Mining District. On February 17, 1994, TCC submitted to the Division a copy of the <br />Mining Plan Approval Document No. CO-0093 for lease COC-53560 in portions of Section 31, <br />TSN, R86W and Section 36, TSN, R87W, encompassing 544 acres, more or less. Thus this <br />stipulation was terminated on February 17, 1994. <br />Stipulation Nos. 389 have been issued since the last fmdings document writing, and have all been <br />terminated, except for Stipulation No. 46, which requires TCC to submit elevation survey <br />information to demonstrate that the prep plant piers will be below the final proposed postmining <br />grade. This stipulation is therefore still active. <br />The active Stipulations to the permit as a result of PR-03 (Eastern Mining District) or those which <br />continue to be active as a result of a previous action are as follows: <br />Stinulation No. 11 <br />PRIOR TO APPROVAL OF ANY MINING-RELATED ACTIVITIES WHICH WOULD POTENTIALLY <br />AFFECT LANDS IN THE NORTH 1/2 OF SECTION lO, TSN, R86W OR THE SOUTHWEST <br />1/4 OF THE SOUTHWEST 1/4 OF SECTION 33, T6N, R86W (THROUGH FUTURE PERMIT <br />REVISION OR RENEWAL) THE PERMITTEE WILL SUBMIT ACCEPTABLE RIGHT-OF-ENTRY <br />INFORMATION TO THE DIVISION. <br />12 <br />
