<br />Mid-Term Review <br />Colowyo Mine -Permit No. C-81-019 <br />This documents presents the results of the Division's mid-term review for the <br />Colowyo Mine. The review was conducted to fulfill the requirements of <br />Rules 2.08.3, 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.7(5) and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued <br />prior to its mid-term. Based on this review, for good cause shown, the <br />Division may require reasonable revision or modification of the permit <br />provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5, 2.06.7 require that experimental practices, <br />mountaintop removal variances, variances from AOC, and variances from <br />contemporaneous reclamation be reviewed by the Division where applicable. <br />kule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bond every 2 1/2 years. This is discussed in <br />section three of this document. <br />The mid-term review for the Colowyo Mine consisted of a detailed review of the <br />findings document, renewal findings document, and the permit application to <br />identify any potential problems. A review was also made of all subsequent <br />revisions and stipulation responses to ensure that all permit commitments and <br />conditions are being followed. Finally the annual reclamation reports were <br />reviewed for completeness and content which may indicate any undesirable <br />environmental impacts that could be occurring as a result of the Colowyo Mine. <br />The document is organized as follows: Section I contains a summary of the <br />review and any change or updates that need to be incorporated into the permit <br />application or submitted to the Division. Section II reviews and summarizes <br />the revisions to the permit and any stipulation response since renewal. <br />Section III discusses the current state of bonding for the Colowyo Mine as <br />required under Rule 3.02.2(4). <br />I. Summary of the Review <br />In general the mine is operating smoothly and mining and reclamation <br />activities are proceeding on schedule. One technical revision (TR-16) <br />was recently submitted and approved to modify post-mining topography. <br />The revision involved a gradual increase of the spoil dump area from 7200 <br />feet to 1300 feet elevation to accommodate an increase in spoil material <br />due mainly to increased coal production, and an imbalance in the strip to <br />dump length. This modification did not constitute a variance to AOC. <br />There is one outstanding permitting issue which requires additional <br />information to complete. This is MR-14 to add Taylor Creek Pond as a <br />permitted facility. The revision is currently incomplete awaiting a <br />certified survey of the pond. This information should be submitted by <br />September 15, 1990. <br />
