Thank you for your concern <br />and participation in identifying these permitting issues. <br />The Division investigated your concerns by inspecting aerial photographs, by reviewing the Golden <br />Eagle mine permit and by conducting an inspection on March 1, 1995. On the basis of our <br />investigation, the Division did not find sufficient basis to issue a notice of violation. However, a permit <br />defect was noted and the mine will be notified that a revision to the permit is required. <br />The review of the permit found that the structural inventory map had not been updated by identifying a <br />barn located approximately 300 feet west of your residence. The windmill however is identified in the <br />regional hydrology map (figure #5 in the permit application) and this is acceptable since all hydrologic <br />structures in the permit azea and in adjacent areas are identified here. <br />When the Golden Eagle mine conducted the initial structural inventory, it identified all structures within <br />the permit area and in the adjacent areas. The barn that you have identified as not being on the <br />structural inventory map was built in 1992, after the structural initial inventory was conducted at the <br />mine. The Division will require that the mine update the inventory to include the barn. <br />To ensure that all structures are protected from subsidence the Division had attached a stipulation to <br />the approval of the recent permit renewal that required Basin Resources to conduct quarterly <br />inventories of structures in the active mining area.
