<br />by the Division to secure adequate financial warranty will, until the permit transfer is <br />approved, be taken against Ryan Ltd. and not Telluride Mining Co. Also, please be <br />aware that the financial warranty increase will be required regardless of whether the <br />Succession of Operator and Permit Transfer is approved or denied. <br />If the permittee and/or successor applicant wish to contest the Division's cost figures, <br />then all issues and disagreements regarding the Division's cost figures will need to be <br />fully resolved and any adjusted financial warranty amounts provided to and accepted by <br />the Division prior to the November 25, 1997 deadline. ' <br />If the permittee and/or successor applicant wish to explore the possibility of utilizing any <br />existing D.O.E. financial warranties to satisfy the Division of Minerals and Geology's <br />reclamation bond requirements, it will be necessary for the permittee and/or the <br />successor applicant to provide to the Division no later than November 25, 1997 <br />sufficient written verification from the D.O.E. that: 11 The entire 9.0 acre area <br />comprising the Division of Minerals and Geology Reclamation Permit is fully covered by <br />a valid D.O.E. Lease; 2) The current D.O.E. Lease holder is the same entity as the <br />Division of Minerals and Geology permittee (Telluride Mining Co. if the permit transfer <br />is approved; Ryan Ltd. if the permit transfer is not approved; 3) The D.O.E. financial <br />warranty fully covers all reclamation activities and associated costs required by the <br />approved Division of Minerals and Geology Reclamation Permit; 4) The D.O.E. will <br />accept full reclamation responsibility for completing all reclamation work required by the <br />State Reclamation Permit in the event the State Reclamation Permit is revoked by the <br />Division of Minerals and Geology. Each of these conditions is necessary since the <br />Division currently has no "memorandum of understanding" regarding financial warranty <br />coverage for the State of Colorado's statutory reclamation bond requirements. <br />In order to have all issues fully resolved by the extended deadline of November 25, <br />1997, you will need to submit the increased financial warranty amount and other <br />necessary information several days prior to the deadline to allow Division staff sufficient <br />time to review your submittal for adequacy. <br />Valid Right to Enter the DMG permitted site to conduct mining operations is not clear. <br />This problem has been adepuately resolved. The Division received written information <br />and a lease area boundary map from Mr. Dan Burns of the D.O.E. demonstrating that <br />the entire 9.0 acre State Reclamation Permit area is covered by a valid D.O.E. lease. <br />3. No mine identification sign or permit area perimeter markers are in place where required. <br />The Division hereby grants one (1) 30 day extension to October 25, 1997 for <br />completing the sign & marker installation work. Please send print photos of the <br />completed installation so that the Division can acknowledge resolution of this problem. <br />4. Growth of weedy plant species beginning to infest several portions of the affected area. <br />This work was required to be completed by September 25, 1997. Your recent <br />correspondence indicated that spraying work would be done during the week of <br />9/22/97. Please verify completion of this work in written correspondence to the <br />Division. <br />2 <br />
