Lochhead <br />Execmive Duecbr <br />rsichael B Long <br />Division Direcbr <br />RE: Ellison Mine, File No. M-78-311, 7/17/97 Inspection Report, Problem Abatement Status <br />Dear Ms. Carter: <br />This letter is in response to your correspondence received by the Durango Field Office on September <br />24, 1997 regarding the resolution of various problems identified in the Division's July 17, 1997 <br />inspection of the site. The following information describes the current status of resolution of each the <br />4 problems identified in the report: <br />1. The site is underbonded by 55,750.00. The original due date for providing the increased <br />financial warranty coverage for the site was September 25, 1997. However, in order <br />to provide you and the current permittee, Ryan Ltd. sufficient additional time to comply <br />with this requirement, the Division will grant one (1) 60 day extension, to November 25, <br />1997. Please be aware that the permit transfer will not be final until Telluride Mining <br />Co., Inc. has completed the Succession of Operator Process by providing the increased <br />financial warranty amount. If the increased financial warranty amount is not provided <br />to and accepted by the Division by the November 25, 1997 deadline, the succession of <br />operator will be denied and Ryan Ltd. will remain the permittee. In this event, Ryan Ltd. <br />will be responsible for providing the increased financial warranty amount by the <br />November 25, 1997 deadline. If Ryan Ltd. does not provide an acceptable increased <br />financial warranty to the Division by November 25, 1997, the Division may proceed with <br />an enforcement action against Ryan Ltd. for failure to provide sufficient financial <br />warranty within the statutory 60 day period. Please be aware that the November 25, <br />1997 due date represents the final deadline for receipt of and acceptance by the <br />Division of the increased financial warranty amount for the Ellison Mine. The Division <br />will grant no additional time extensions beyond the November 12, 1997 deadline. <br />The permit transfer process has not been completed because the applicant for the <br />Succession of Operator, Telluride Mining Co., Inc. elected to have the Division <br />recalculate the required financial warranty amount prior to final approval of the transfer. <br />As such, the current permittee remains Ryan Ltd. and any enforcement actions taken <br />1 <br />
