<br />F. Impoundments <br />The applicant has not proposed the use of alternative design criteria and <br />specifications for impoundment design and construction. (4.05.9(4)- (6)) <br />G. Surface and Ground Water Monitoring <br />The applicant will conduct monitoring of ground water in a manner approved <br />by the Division. The ground water monitoring plan is outlined beginning on <br />page 2.05-] 08a of the permit application and includes both alluvial wells and <br />bedrock wells. (4.05.13(1)) <br />The applicant will conduct monitoring of surface water in a manner approved <br />by the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv) <br />and is outlined beginning on pages 2.05-105 of the permit application and <br />includes surface water stations, springs and seeps, and stock ponds. <br />(4.05.13(2)) <br />H. Transfer of Wells <br />At this time, Lorencito Coal Company, LLC has not requested a transfer of <br />an exploration or monitoring well. (4.05.14 (3)) <br />Discharge of Water into an Underground Mine <br />No specific approvals are granted under this section. <br />J. Stream Buffer Zones <br />The Division approves surface mining activities within 100 feet of a <br />perennial stream or stream with a biological community. This decision is <br />based on a finding that the original stream channel will be restored, +vater <br />quality and quantity shall not be adversely affected, and appropriate riparian <br />vegetation will be reestablished. The buffer zone variance is granted for the <br />areas located along Lorencito Creek where the haul road, access road, or <br />topsoil piles are adjacent to the Lorencito stream channel. (4.05.18(1)) <br />IV. Topsoil <br />A. The Division waives the requirement for clearing of vegetation cover prior to <br />topsoil removal on areas that will be treated using the Rotoclear machine.
