Box 15596 <br />Lakewood, Colorado <br />Re: Technical Revisions, New Elk Mine, File C-012-81 <br />Dear Mr. Stout: <br />There are four revisions for the New Elk mine which are outstanding, and are a <br />cause of concern on behalf of the Division. Two of these revisions were <br />initiated as abatement requirements for violations. <br />The first revision involves a Thickener Discharge Plan, and is referenced to <br />N.O.V. C-85-004. An initial submittal was received on March 22, 1985, and <br />later withdrawn by Wyoming Fuel Company (WFC) on April 12, 1985. A second <br />technical revision request was submitted on May 29, 1985. The request was <br />deemed complete, and adequacy comments were presented on June 14, 1985. To <br />date the Division has received no response to these comments. Wyoming Fuel <br />Company should be advised that without an approved Thickener Discharge Plan, <br />a~ discharge from the wash plant would be in violation of the approved <br />permit. Additionally, the Division is considering instituting a revision to <br />the permit which would not allow operation of the wash plant until a Thickener <br />Discharge Plan has been approved. The Division urges WFC to submit the <br />required information immediately so that review of the technical revision may <br />proceed. <br />The second revision involves permitting of an approved non-coal waste disposal <br />area, and is referred to in N.O.V. C-85-042. An initial submittal was <br />received during afield inspection on June 28, 1985. In reviewing this <br />document on site, several deficiencies were noted. At that time, WFC made <br />several verbal commitments, including sealing a drill hole in the proposed <br />area, and channeling certain drainage around the proposed dump. It was <br />expected that the additional information and commitments would be formally <br />submitted within two weeks. WFC should be informed that any use of this area <br />as a non-coal waste disposal site without prior approval by the Division would <br />be in violation of the approved permit.
