O'Brian, Vice President <br />Environment, Inc. <br />7985 Vance Drive, Suffe 205A <br />Arvada, Colorado 80003 <br />JAN 21 1994 <br />C'r•i~;~ <br />a ci m..-~,,. <br />,.~1=.~.:n~ <br />Dear Mr. O'Brian: <br />In reference to your request fora determination for the need of a <br />Certificate of Designation (CD) in lieu of the Mined Land Reclamation <br />Board hearing for the Road Runners Rest II, Case Numbers 23-84-C and <br />20-92-C(A), there are three issues that need to be addressed. <br />The first issue is to determine if Adams County will require a CD for the <br />importation of inert material to be used for backfill. This decision is <br />developed by using the CDH's DECISIONS section of the Draff <br />Document for Waste Policy/Guidance Document Concerning Inert <br />Materials Disposal Sites (Draff Document). <br />Using the CDH Draff Document it is apparent that the Road Runners Rest <br />II Pit would require at least an operations plan to be reviewed by the <br />CDH. This is based on the fact that the site size is over 10 acres. <br />The second issue is to determine if a CD will be required for past back <br />filling of inert material generated on site. <br />In this case, the use of on site materials for backfill does not require a <br />Certificate of Designation (CD) and none will be sought by Adams <br />County. <br />The third issue concerns waste generated through an industrial activity <br />and disposed of by back filling such waste into a gravel mine pit. <br />The manufacturing and distribution of concrete requires the use of water <br />both in the manufacturing phase and in the cleaning of equipment. <br />Concrete that has not been in a hardened state and cured for sixty days <br />is considered special waste. Washing 'come back concrete' into water <br />that has a direct connection to ground water will be considered <br />'Degrading the Waters of Colorado'. <br />BOARD OF COUNTY EIAINE T.
