~: <br />Section III -Status of Stipulations <br />STIPULATION NO. 22 -- THE PERMITTEE WILL SUBMIT ADDITIONAL BOND IN THE <br />AMOUNT OF $25,147.00 TO THE DIVISION WITHIN THIl2TY DAYS AFTER THE <br />PUBLIC COMMENT PERIOD ENDS. THE PERMIT WII,L NOT ISSUE PRIOR TO <br />ACCEPTANCE AND APPROVAL OF THE BOND BY THE DIVISION. <br />Status --The required additional bond, a $25,147.00 certificate of deposit was submitted <br />to and accepted by the Division prior to issuance of the renewal permit. <br />Stipulation Resolved and Terminated <br />STIPULATION NO. 23 -- WITHIN 30 DAYS OF PERMIT ISSUANCE, THE OPERATOR <br />WILL SUBMIT A RELEVANT SHOWING STATEMENT IN LIEU OF CERTIFICATION <br />FOR THE MCCLANE ACCESS/HAUL ROAD, PURSUANT TO RULE 4.03.1(1)(d)(ii). <br />Status -- An acceptable road compliance/relevant showing statement was submitted to the <br />Division, dated September 18, 1997. <br />Stipulation Resolved and Terminated <br />STIPULATION NO. 24 -- TABLE 3.1-1 WILL BE EXPANDED TO ADDRESS THE <br />RECLAIIvIED CHANNELS IN THE VICINITY OF THE RECLAIMED LOWER ACCESS <br />ROAD AND SEDIIvIENT POND/TOPSOIL STOCICPII,E SITE. RIPRAP SIZING, <br />GRADATION, AND INSTALLATION DESIGN DETAILS WILL BE PROVIDED FOR <br />THOSE CHANNEL SEGMENTS WHICH REQUIl2E RIPRAP PROTECTION, AND <br />RECLAMATION PLAN TEXT WILL BE AMENDED TO SPECIFY THAT CONCRETE <br />FROM FOUNDATIONS AND OTHER SOURCES WILL BE BURIED AT LEAST FOUR <br />FEET BELOW GRADE, IN LOCATIONS OTHER THAN THE RECLAIIvtED CHANNELS. <br />THESE AMENDMENTS WILL BE SUBMITTED WITHIN A COMPLETE TECHNICAL <br />REVISION APPLICATION WITHIN 60 DAYS OF PERMIT ISSUANCE. <br />Status -- Several iterations of channel designs were submitted within TR-09 to address <br />this stipulation and subsequent adequacy review concerns identified by the Division. <br />Design information included in the operator's November 24, 1998 adequacy response <br />submittal was determined to be acceptable. <br />Stipulation Resolved and Terminated <br />STIPULATION NO. 25 --NARRATIVE DESCRIPTION, LONGITUDINAL PROFILE, AND <br />APPROPRIATE CROSS SECTIONS OF THE TEMPORARY DIVERSION CHANNEL <br />CREATED BY THE ROAD CROSSING OF THE MCCLANE DRAINAGE CHANNEL WILL <br />BE SUBMITTED FOR INCLUSION IN THE APPLICATION, ALONG WITH APPLICABLE <br />
