Mr. Jim Stevens 2 claim group. On January 9, 1985, Mr. Ellis replied to another letter I had sent him on January 2, 1985, clarifying the exact locakion of the proposed millsite. In this letter, Mr. Ellis stated that "The proposed millsite as indicated on the map you sent is also located in the Forestry Zoning District, and is allowed as a use by right in that district. Therefore, as long as the millsite and any legal activities produced from mining from the site remain on land zoned Forestry, the use would be acceptable in the Forestry Zoning District." Copies of this January, 1985, correspondence are also attached to this letter. Based upon these representations, the Boulder County Land Use Department issued a building permit on November 12, 1985 for the wnstruction of the Gold Hill Ventures' milling facility. A copy of that Boulder Count building permit numbered 32416 is included with this response letter. Under the section titled "REMARKS" the building permit states that the approval of the permit was issued upon the following three conditions: ~/ "To process minerals extracted from the property only." /"Milling Accessory to underground mining on the same property only -- no custom milling using imported ore." ~/"This building permit approval and occupancy and use of the mill is contingent upon receiving prior approvals from the Mined Land Reclamation Board and any other applicable federal, state and local agencies." This amended permit application was a matter of some concern in the local mountain community. At the special Gold Hill town meeting held September 19, 1985, called for the purpose of reviewing the mining and milling permit application, the residents were assured by me that the mill would not be used as a custom milling facility or to process imported ores. Mr. Richard H. Fraser and several senior employees of a company owned by Mr. and Mrs. ~r were in attendance at that Gold Hill town meeting. Following the construction of the Gold Hill Mill, the facility processed approximately 2,500 tons of development ore from the Cash mine that was stockpiled on the mine dump.
