W I T N E S S E T H
1J11EREAS, GEC Minerals, Inc. desires to continue conducting a(n) open mining
operation, known as GEC Strip Ptiite, for the purpose o1' extracting open mined
coal; and,
IJHEREAS, GEC Minerals desires to consolidate and convert all previously
Held permits to include ail lands previously mined since July 1, 1969, and all
lands presently permitted which have not yet been mined, and to amend the
existing permit by an addition of acreage: and
WHEREAS, The Mined Land Reclamation Board has received an application for
a conversion of tite previous permit issued under the Colorado Open Plining
Reclamation Act of 1973 and a request for additional acreage, a reclamation plan
and map, the required fee, and a bond or surety for such operation be required
by law. The life of the mine permit to be issued will include all of these
lands. Previous bonds supplied by GEC Minerdls, Inc. will be released by the
Board upon submission of a new comprehensive bond which specifically includes
coverage of lands previously mined but not reclaimed by CEC and its pre-
decessor under previous permit bonds; and,
WHEREAS, the Plined Land Reclamation Board leas made a finding, for the pur-
pose of issuing this permit, that:
1) the application complies with the requirements of the Colorado
Plined Land Reclamation Act and all applicable local, state attd
Federal laws; and,
2) the operation will. not advE~rsely affE.ct tlfe stability of any
significant, valuable, an~i permanent man-made: structures loca[.c:d
within two hundred feet of the affected land, except where there
is an agreement between the operator and the persons having
an interest in the structure that damage to t:he structure is to be
compensated for by the operator; and,
3) the proposed mining operations and reclamation can be carried nut
in conformance with the requirements of C.R.S. 1973, 34-32-116,
as amended (1976 Sess Laws - H.B. 1965); and
IJHEREAS, for the purpose of issuing this permit, the operator Itas made a
satisfactory showing to the Board that he will. employ during and after ltis open
mining operations procedures reasonably designed to minimize as much as practicable
the disruption from the open mining operations and will provide for rehabili-
tation of plant cover, soil stability, water resources, and other measures
appropriate to the subsequent beneficial use of such mined and reclaimed lands;
and that in the event of the Failure of his proposed reclamation plan, Ile will take
whatAver measures which may be necessary in order' to assure the success of
reclamation of the lands affected by his open mining operations; and,
IJkIEREAS, Eor the purposes of issuing this permit, a copy of the application
approved by tite Plined Land Reclamation Board of the State of Colorado is attached
to this permit and thereb/y becomes a part of the terms hereof.
