<br />A <br />~~ <br />• (2) for POLLUTION LIABILITY in connection with the ownership or operation by an INSURED of e <br />facility or site for disposal, dumping, burying, 'Storage ; Inclneratlon or treatment of <br />POLLUTANTS; however, this subsection (2) shall not apply to a facility which Incinerates <br />refuse for the purpose of generating usable energy. <br />(3) for any POLLUTION LIABILITY, cost or expense arlsing out of any testing for or monitoring, <br />clean up, containment, treatment, detoxification or neutrallzatlon of disposed of <br />POLLUTANTS on or the removal thereof from: <br />(a) property owned or occupied by or rented to the INSURED; <br />(b) property used by the INSURED; or <br />(c) property In the care, custody or control of the INSURED or as to which the INSURED <br />Is for any purpose exercising physical control. <br />The term 'Acid Raln' as used In this Exclusion shall mean any acidic deposition from the <br />atmosphere whether wet or dry or a mixture thereof. Deposition shall be deemed acidic If Its pH <br />Is less than 5.6 on the logarithmic pH scale of zero to 14. <br />The term 'Disposal' as used In this Exclusion shall mean the completion of any physical transfer <br />of POLLUTANTS or of any substance, material or equipment containing POLLUTANTS for the <br />purpose of disposal, dumping, burying, 'Storage ; Inclneratlon or treatment to remove, detoxify <br />or neutralize the hazardous properties thereof whether or not such physical transfer has been <br />made to or from a place on or off premises owned, occupied, rented or controlled by an <br />INSURED. <br />The term 'Storage' as used In this Exclusion shall mean the permanent holding or temporary <br />holding fora period of twelve (12) months or more, either above or below ground, of <br />POLLUTANTS or of any substance, material or equipment containing POLLUTANTS; however, the <br />term 'Storage' shall not mean the holding of fuels or materials In the ordinary course of the <br />INSURED'S business. <br />(H) far any expense Incurred by the INSURED In regaining control of any well if the INSURED has an <br />ownership and/or operating Interest and/or contractual responsibility In or for such well; however, <br />this Exclusion shall not apply to the expense of regaining control of a well, the property of <br />others, for which the INSURED may become liable. <br />(A for any obligation for which the INSURED, or any prrler as his Insurer, may be held liable under <br />any workers' compensation law, Including statutory occupational disease benefits and United <br />States Longshoremen's and Harbor Workers' Act, unemployment compensation or disability <br />benefits laws, or under any other similar law. <br />(J) for Ilabillty of an INSURED of any nature whatsoever which Is attributable or related to BODILY <br />INJURY to any employee of such INSURED arlsing out of the employment of such employee; <br />however, this Exclusion and the Nuclear Energy Llabillty Exclusion (Broad Form) shall not apply to <br />employers' Ilabllity, to Ilabllity under the Federal Employers' Llabillty Act or to Ilabillty under the <br />Jones Act If a specific UNDERLYING LIMIT is stated In the Underlying Limits Schedule with respect <br />to such Ilabllity. This Exclusion (J) shall not apply to Ilabillty assumed by the INSURED under <br />CONTRACT. <br />(K) for any floes or penalties Imposed for final adJudlcatlon of a court of competent Jurisdiction or <br />any agency or commission possessing quasi-Judicial authority. <br />(U for Ilabllity of any INSURED for BODILY INJURY, PERSONAL INJURY or PROPERTY DAMAGE <br />caused Intentionally by or at the direction of such INSURED; however, this Exclusion shall not <br />apply with respect to BODILY INJURY, PERSONAL INJURY or PROPERTY DAMAGE which occurs <br />while safeguarding, preserving, protecting or defending person ar property. <br />eioo (veo~ [9 of i5 ] <br />
