(4) the INSURED'S PRODUCTS arlsing out of such products or any part of such products; or I
(5) work performed by or on behalf of the INSURED arising out of such work or any portion
thereof, or out of materials, parts or equipment furnished In connection therewith.
(C) for Ilability resulting from the failure of the INSURED'S PRODUCTS or work completed by ar for
the INSURED to perform the function or serve the purpose Intended by the INSURED, if such
failure Is due to a mistake or deficiency In any design, formula, plan, specifleatlons, advertising
material or printed Instructions prepared or developed by any INSURED; however, this Exclusion
shall not apply to Ilability resulting from the active malfunctioning of such product or work.
(D) only with respect to the PRODUCTS LIABILITY and COMPLETED OPERATIONS UABIUTY:
(1) far loss of use of tangible property which has not been physically damaged or destroyed
resulting from:
(a) a delay In or lack of performance by or on behalf of the INSURED of any contract or
agreement; or
(b) the failure of the INSURED'S PRODUCTS or work performed by or on behalf of the
INSURED to meet the level of performance, quality, fitness or durability warranted or
represented by the INSURED; however, this Exclusion shall not apply to loss of use of
other Tangible property resulting from the sudden and accidental physipl damage to or
destruction of the INSURED'S PRODUCTS or work completed by or on behalf of the
INSURED after such products or work have been put to use by any person or
organization other than the INSURED; or
(2) for Ilability arising out of the withdrawal, Inspection, repair, replacement or lass of use of
the INSURED'S PRODUCTS or work completed by or for the INSURED or of any property of
which such products or work form a part, If such products, work or property are
withdrawn from the market or from use.
(E) for Ilability with respect to the FAILURE TO SUPPLY LIABILITY unless:
(1) such failure is caused by an OCCURRENCE: end
(ti the combined ppacity of the INSURED'S Installed production facilities and contractual supply
arrangements Is equal to or greater than one hundred and ten percent (110X) of the
electricity demand or one hundred percent (100X) of the gas demand (whichever demand Is
applicable) Immediately preceding such failure, on the INSURED'S electric or gas system.
(F) for the cost of removal of debris or wreck from any navigable body of water If the INSURED
has or had, prior to loss, an ownership and/or operating Interest and/or contractual responsibility
In ar for such debris or wreck; however, this Exclusion shall not apply with respect to
POLLUTION LIABILITY or the cost of removal of any debris or wreck, the property of others,
for which the INSURED may become liable.
(G) (t) for Ilability based upon, arlsing out of or attributable to:
(a) any actual, alleged or threatened discharge, dispersal, release or escpe of any
POLLUTANTS, subsequent to the 'Disposal' of such POLLUTANTS, Into or upon any
person, thing or place Including the land, the atmosphere, any man-made structure and
any above or below ground watercourse or body of water; or
(b) any actual, alleged or threatened discharge, dispersal, release or escape of any
~. substance(s) Into or upon any person, thing or place Including the land,. the
atmosphere, any man-made structure end any above or below ground watercourse or
body of water resulting In the formation of 'Acid Rain', whether or not such
discharge, dispersal, release or escape Is cumulative, gradual or sudden and accidental.
