(970)._8647980 <br />................................................. <br />"~:..., <br />FROM: DOUG CONGER <br />bn of Adinerals tE Geolccy <br />MESSAGE ~I <br />Today is the last day of the extension I was able to secure for responses to the inspection report <br />directives of April 16, 'Ol for deficiencies at West End Pit #l. <br />Of particular importance in showing due diligence is giving DMG a satisfactory assurance that <br />O topsoil stockpiles are protected and that 0 the required silt fence at the sediment pond outlet <br />has been installed. <br />West End Gravel would be in a particularly vulnerable position before The Board or in court if <br />DMG could show intentional negligence in performance of the required mining plan features he <br />cited in his inspection report. They carry grave consequences, especially if West End profited <br />(i.e., saved money) as a result of such intentional negligence. <br />Although one could postpone indefinitely the costs of reclamation by continually adding to the <br />bond, to do so makes DMG extremely nervous about getting stuck. It invites amplified scrutiny <br />of the operation by DMG inspectors and exaggerated claims of bonding cost requirements. <br />Often there can be substantial cost savings in performing some of the reclamation grading and <br />other reclamation tasks during operations while equipment with periodic idle time is available. <br />And it sure keeps DMG a lot happier and out of our hair. <br />As directed, I have drafted a response letter for immediate submittal, however I need some <br />direction in what you want to tell them about the two items numbered above. (See the third and <br />the last bulleted items in the following response letter). I will continue with the Reclamation <br />Cost analysis for increasing the bond and the amended drawing to go with this response, and will <br />stand by for your direction on the above two items. <br />JJou9 C.nyir <br />1 <br />
