Moschner durina Somerset Inspection on <br /> March 1 , 1989 <br /> During the March 1 , 1989, complete inspection of the Somerset Mine, Mr. <br /> Moschner approached OSM Inspector Byrnes while we (MLRD Inspectors Cathy Beae.i <br /> and Matthew Haves) were at the loadout. Mr. Moschner expressed concerns about <br /> the Bear and the West Elk Coal Company (WECC) operations as they impacted his <br /> home and the town of Somerset. <br /> Mr. Moschner was most concerned about the speed of truck traffic throuqh the <br /> town of Somerset by Bear coal trucks. He felt that they frequently exceeded <br /> the speed limit and that they presented a threat to school children awaitinq <br /> the bus. (He indicated that he felt that calls to the Gunnison County sheriff <br /> had Droved unsatisfactory as the patrolman would only write violations based <br /> on the use of speed detection devices. ) In addition, he was concerned that <br /> the coal trucks and overloading resulted in the dispersion of coal alona the <br /> riaht-of-way. Lastly, he was concerned that emissions from the Bear stacker <br /> tube contributed to dirtying his off-white colored home. He claimed he had to <br /> wash his entire house down three times per year. Interspersed throuahout this <br /> litany of concerns was the complaint that Bear Coal Company had become <br /> unapproachable since the strike last summer. (Mr. Moschner is an older <br /> gentleman and was wearing a ball cap with a UMW insiqnia on it. ) <br /> Mr. Moschner also expressed concern about the speed of WECC haul trucks and <br /> their dispersion of coal upon the riaht-of-way. In addition, he believes the <br /> town's water ouality had deteriorated recently. He claimed that water left <br /> scale deposits and that other townspeople felt it smelled badly.
