Submitted March 23, 2001. <br />Decision issued April 11, 2001. <br />TR-38 Degasification wells CBM- 6,7,8, 9, l0 and 11 and associated access <br />roads. Submitted March 23, 2001. Decision issued March 28, 2001. <br />Section III. -Status of Stipulations <br />According to the Division's records in our permitting database, there are two outstanding <br />stipulations and one on-going commitment attached to Permit No. C-81-022. These are <br />listed below. <br />Stipulation 16 The operator will, pursuant to Rule 4.10.2(2)(B), submit to the <br />Division as part of the quarterly coal mine waste pile inspection <br />report, compaction test results for that pile. Testing will take place <br />on an as-needed basis, depending on the rate at which the pile <br />receives coal mine waste, to ensure stability of the pile. <br />Issued May 28, 1993. <br />Stipulation 33 Any discharge of water from the amended CDPS discharge point <br />shall be in compliance with the conditions and limitations of the <br />Colorado Dischazge Permit (CO-000132) for the Sanborn Creek <br />Mine in effect at the time the discharge occurs. <br />Issued April 30, 1999. <br />Commitment 1 Somerset Mining Company will address inundation of Sanborn <br />East workings by water in possibly flooded Hawk's Nest workings <br />entered through borehole No. 8. See page 2.05-39IV B of the <br />Somerset Permit. <br />Issued September 25, 1992. <br />OMI regularly submits quarterly coal mine waste pile inspection reports as required by <br />Stipulation 16. The most recent report, submitted in January 2001, however was not <br />signed and it was missing some of the information. OMI has yet to resubmit the report <br />for the East Yard fill and the West Valley fill. <br />Stipulation 33 is ongoing and serves as a reminder to OMI and the Division. <br />Commitment 1 remains from the Somerset Mine. The referenced page from the permit <br />could not be located.
