Concurrence with Bureau of Land Management ~BLMI <br />Ma~13, 2003, Water Replacement Plan Conditions. <br />Dear Mr. Belt: <br />In compliance with Section 15(d)(1) of the Elk Creek Federal Coal Lease, COC61357 <br />Oxbow Mining, LLC (OMLLC) has developed a water replacement plan to replace the <br />possible loss of water resulting from mining activity authorized under the lease. OMLLC, <br />the BLM and the U. S. Forest Service (USFS) have worked together on a number of <br />versions of the plan. The final version of the plan is dated April 15, 2003. <br />The BLM correspondence of May 13, 2003 approved the measures proposed in the plan, <br />subject to OMLLC's written concurrence of seven (7) conditions. $LM's mine plan <br />approval concurrence to the Office of Surface Mining is contingent upon OMLLC's <br />written concttrrence with those conditions. <br />By execution of this letter below, the purpose of this letter is to provide BLM with <br />OMLLC's written concurrence with the seven (7) conditions presented in the subject <br />May 13, 20031etter. <br />OMLLC appreciates the efforts by the BLM to work with OMLLC to ensure compliance <br />with the terms of the lease. <br />Please contact Jim Kiger at 970-929-5806 if you have any questions or need any <br />additional information regazding this issue. <br />Sincerely <br />(ZMg2d ~°'s-T' <br />~es T.
