~` ~ • <br />i <br />Mid-Term Review <br />Seneca II-W (C-82-057) <br />This document presents the results of the Division's Mid-Term Review of <br />Peabody Coal Company's Seneca II-W Mine. This Mid-Term Review was conducted <br />to fulfill the requirements of Rules 2.08.3, 2.06.2(9), 2.06.3(4), 2.06.5(3), <br />2.06.7(5), and 3.02.2.(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its mid-term (2-1 /2 years). Based on this review, for good cause <br />shown, the Division may require reasonable revisions or modifications of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, <br />mountaintop removal variances, variances from approximate original contour <br />(AOC), and variances from contemporaneous reclamation respectively, be <br />reviewed by the Division where applicable during the Mid-Term Review. The <br />Seneca II-W Mine does not have any experimental practices or any variances <br />from mountaintop removal or AOC. However, the Division previously granted a <br />variance from contemporaneous reclamation (see Section IV). <br />Rule 3.02.2.(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bond every 2 1/2 years. <br />This Mid-Term Review consisted of a detailed review of the Seneca II-W Mine <br />permit application and findings document to identify any items that may have <br />been overlooked during the initial review. The Division also reviewed all <br />subsequent revisions and stipulation responses to ensure that all permit <br />commitments and conditions were being followed. F(ydrologic monitoring data <br />was reviewed in conjunction with the review of the application to assess the <br />adequacy of the monitoring plan and discussion of hydrologic impacts. <br />Problems and observations from past inspection reports were also considered. <br />Section I- History <br />Peabody Coal Company (Peabody) submitted a permit application to conduct <br />surface coal mining operations at the Seneca II-W Mine on November 29, 1982. <br />The application was deemed incomplete on December 8, 1982. Peabody <br />resubmitted an application on December 7, 1984 which was deemed completed on <br />December 31, 1984. The initial adequacy review letter was forwarded to <br />Peabody on March 5, 1985 with Peabody responding to this letter and updating <br />the application document on May 1, 1985 and June 7, 1985. During the initial <br />public comment period that began on January 10, 1985, public comment was <br />received from four different entities. These comments were adequately <br />addressed and resolved by Peabody. <br />The Division's decision to approve the Seneca II-W Mine permit application, <br />subject to thirteen stipulations, was proposed on August 8, 1985. No public <br />comment was received during the final comment period, therefore, this decision <br />became final on September 16, 1985. Peabody submitted a E2 ,646 ,300.00 <br />corporate surety on September 17, 1985 and the permit for the Seneca II-W Mine <br />was issued on December 31, 1985. <br />-1 - <br />
