This <br />letter was previously transmitted to Mountain Coal Company (MCC). On July 23, 1996 the <br />Division of Minerals and Geology (DMG), conducted an inspection of the areas discussed in the <br />letter. Both Mautz and Mountain Coal Company representatives were present during the <br />inspection. <br />It is our position that Mountain Coal Company must comply with all aspects of Rules 2.05.6(6) and <br />4.20. Compliance with any other rules applicable to the situation is also required. Specifically, <br />risks to public health and safety must be prevented. All structures including, but not limited to, <br />roads, buildings, reservoirs, and stock ponds must be protected from damage. If damage occurs, <br />then the damage must be repaired. Material damage, and any damage which results in the <br />diminution of the value or reasonably foreseeable use of the land must also be mitigated. <br />We are requesting the following information: <br />I) A detailed map of all surface cracks observed during the July 23, 1996 inspection. Include <br />topography, crack dimensions, crack orientation, and apparent displacement. Please also <br />conduct detailed ground observations to inventory any other such features tlvoughout the <br />landscape which may not have been specifically observed on July 23, 1996. Provide <br />detailed mapping of any additional surface cracking or subsidence-related features, and <br />recent or active landslides. Be sure to include the Lone Pine road referenced in the Mautz <br />letter of July 10, 1996. <br />
