Lamoreux - 4 - December 15, 1989 <br />Task 17 <br />The proposal in the December 1 letter is acceptable. <br />Task 18 <br />The currently approved plan specifies that the sediment pond would not be <br />removed until a successful stand of vegetation is established on the reclaimed <br />area. However the landowner, Mr. Tony Sarver, has requested that the pond be <br />reclaimed at the same time as the mine site reclamation. Therefore, we would <br />request that the sediment pond on Mr. Sarver's land be reclaimed as a <br />component of the reclamation work in the summer of 1990. An alternative plan <br />.for controlling sedimentation from the reclaimed mine will need to be <br />submitted and approved prior to reclamation of the existing sediment pond. An <br />acceptable approach might be the construction of a small sedimentation basin <br />on the north side of the county road, in conjunction with a combination of <br />straw bale dams, filter fabric fences or dug out sediment traps at the base of <br />reclaimed slopes and other areas where drainage would be concentrated upon <br />completion of reclamation. These alternative sediment controls would need to <br />be removed or reclaimed upon successful vegetation establishment, and prior to <br />final bond release. <br />In summary, it appears that progress is being made toward developing a <br />satisfactory plan and schedule for reclaiming the La Plata No. 1 Mine. Upon <br />submittal of a more detailed plan which satisfactorily addresses the portal <br />backfilling and compaction concerns addressed under Task 7 and 10, and a <br />sediment control plan addressed under Task 18, the Division would be prepared <br />to recommend that the Board conditionally approve the Bank's request to assume <br />the reclamation responsibility. The backfilling and sediment control plans <br />should be submitted no later than January 26, 1990, as we do not want to delay <br />the Board hearing past February. If acceptable plans are not submitted by <br />that time, we will recommend that the Board deny the Bank's request at the <br />February Board meeting. <br />We would be happy to meet with you or your consultants to discuss these <br />issues.
