Box 389 <br />Florence, Colorado 81226 <br />RE: La Plata Mine Reclamation <br />File: C-87-072 <br />Dear Mr. Lamoreux: <br />We received your letter dated December 1, 1989 which addressed the various <br />reclamation tasks and presented a timetable for initiation and completion of <br />reclamation at the La Plata No. 1 Mine. In general, yaur proposal and <br />timetable is acceptable, although additional detail will need to be provided <br />regarding certain tasks to insure that both the Division and the Bank are in <br />agreement on the final design specifications. Items requiring further <br />clarification are addressed under Reclamation Tasks, below. <br />Your letter mentions the possibility of having a new operator re-permit the <br />mine. We need to stress that re-permitting the site is not an option <br />available at this point. On May 1, 1989 the Mined Land Reclamation Board (the <br />Board) ordered the reclamation bond to be forfeited unless a complete coal <br />application were to be received by the Division by July 1, 1989. A complete <br />coal permit application was not received by July 1, and the Division at that <br />time initiated bond forfeiture proceedings with the intent to secure <br />reclamation of the site in a timely manner. On July 26, 1989 we were <br />contacted by the Bank and advised that you, as the surety, wished to be given <br />the opportunity to perform the reclamation rather than forfeit the bond. Rule <br />3.04.2(5) of the Coal Regulations states, "bond forfeiture may be avoided if <br />the surety company can demonstrate the ability to complete the reclamation <br />plan to the Division." Pursuant to the above regulation, the Division has <br />suspended the bond forfeiture to allow the Bank sufficient time to make the <br />necessary demonstration. When we are satisfied that the Bank has presented <br />the information necessary to meet the requirement of Rule 3.04.2(5), we will <br />recommend to the Mined Land Reclamation Board that the Bank be given the <br />opportunity to carry out the reclamation under the supervision of the <br />Division, subject to certain conditions. If we are not satisfied that the <br />Bank has made the necessary demonstration, we will recommend to the Board that <br />the Bank's request be denied. <br />
