2. Compliance with Special Lease Stipuiations and Appli ReauTations We have determined that the lessee will not be required under Section 15, Special Stipuiation 2(a) and Section 31, Special Stipulation (h)(1) to conduct a paieontological appraisal of the land contained in read,)usted Federal leases C-0127865, C-0126480 and C-30655. However, the lessee will still be obligated to comply with Sec. 15, Special Stipulations 1(d), 3, and 2(b), (c), (d), (e) and (f) and Sec. 31, Special Stipulations (h)(2), (3), (4), (5) and (5) concerning discovery of paleontological and cultural resources on readjusted leases C-0126480, C-0127865 and C-30656. The mine plan does not require compliance with these lease sections.on discovery of paleontological resources. We request that a statement similar to the one contained on page 2.04.4-2 be incorporated into the geology section of the mine plan to clarify the lessee's commitment to comply with these Federal lease stipulations. We have determined that no wildlife habitat loss or displacement from historic habitat will occur on the lands in Federal lease C-30656. Compliance with Sec. 31, Special Stipulation (b) of lease C-30656 • will not be required in this revision. We have not received the socio-economic and transportation impact mitigation stugy required under Sec. 31, Special Stipulation (c) of Federal lease C-30656. In order to complete our review of this revision, this requirement must be addressed. It is not clear if the proposed method of permanently sealing drill holes on the federal leases complies with our agency regulations. A statement on Page 4.01-18 refers to a detailed discussion of the seating of drill holes in Section 2.05.4, Reclamation Plan. We could not find this discussion. We request that this discussion be developed in compliance with 43 CFR 3484.1(a)(1) and incorporated into Section 4.07, Sealing of Drill Holes and Underground Openings rather than cross referencing it into another section. No other compliance problems with special lease stipulations or applicable agency regulations were identified. 3. Identification of Land Unsuitable for Surface Minin and Reclamation Pursuant to 3 CFR 346 In our land use planning process no Federal lands within the permit boundary have been designated as unsuitable. However, the following lands within Federal lease C-30656 have been identified as bald eagle roost and concentration areas: T.SN., R.91W., 6th P.M. Sec. 8: lots • 3, 4, 7. These sands were protecte prev ous y tough Sec. 2 of OSM's permit number CO-0019. We recommend that this protection be carried forward into the permit approval of the sub,)ect revision.
