Compliance with Special Lease Stipuiations and Appli <br />ReauTations <br />We have determined that the lessee will not be required under Section <br />15, Special Stipuiation 2(a) and Section 31, Special Stipulation <br />(h)(1) to conduct a paieontological appraisal of the land contained <br />in read,)usted Federal leases C-0127865, C-0126480 and C-30655. <br />However, the lessee will still be obligated to comply with Sec. 15, <br />Special Stipulations 1(d), 3, and 2(b), (c), (d), (e) and (f) and <br />Sec. 31, Special Stipulations (h)(2), (3), (4), (5) and (5) <br />concerning discovery of paleontological and cultural resources on <br />readjusted leases C-0126480, C-0127865 and C-30656. The mine plan <br />does not require compliance with these lease sections.on discovery of <br />paleontological resources. We request that a statement similar to <br />the one contained on page 2.04.4-2 be incorporated into the geology <br />section of the mine plan to clarify the lessee's commitment to comply <br />with these Federal lease stipulations. <br />We have determined that no wildlife habitat loss or displacement from <br />historic habitat will occur on the lands in Federal lease C-30656. <br />Compliance with Sec. 31, Special Stipulation (b) of lease C-30656 <br />• will not be required in this revision. <br />We have not received the socio-economic and transportation impact <br />mitigation stugy required under Sec. 31, Special Stipulation (c) of <br />Federal lease C-30656. In order to complete our review of this <br />revision, this requirement must be addressed. <br />It is not clear if the proposed method of permanently sealing drill <br />holes on the federal leases complies with our agency regulations. A <br />statement on Page 4.01-18 refers to a detailed discussion of the <br />seating of drill holes in Section 2.05.4, Reclamation Plan. We could <br />not find this discussion. We request that this discussion be <br />developed in compliance with 43 CFR 3484.1(a)(1) and incorporated <br />into Section 4.07, Sealing of Drill Holes and Underground Openings <br />rather than cross referencing it into another section. <br />No other compliance problems with special lease stipulations or <br />applicable agency regulations were identified. <br />3. Identification of Land Unsuitable for Surface Minin and Reclamation <br />Pursuant to 3 CFR 346 <br />In our land use planning process no Federal lands within the permit <br />boundary have been designated as unsuitable. However, the following <br />lands within Federal lease C-30656 have been identified as bald eagle <br />roost and concentration areas: T.SN., R.91W., 6th P.M. Sec. 8: lots <br />• 3, 4, 7. These sands were protecte prev ous y tough Sec. 2 of <br />OSM's permit number CO-0019. We recommend that this protection be <br />carried forward into the permit approval of the sub,)ect revision. <br />
