Stipulation No. ?: <br />The permittee will accomplish inspections of the Streeter Canyon ?ill and <br />submit certified inspection reports to the regulatory authority in <br />accordance with the requirements of the plan 3esigned in accordance with <br />Rule 2.05. These inspections and certified inspection reports will include <br />specific examination and discussion of the facial conditions of the fill, <br />in order to determine whether the development of perched water tabl=s <br />within the fill is affecting its surficial slope stability. Further, if <br />the required engineering inspections determine that surficial slope failure <br />conditions are imminent, or if surficial slope failure manifests itself <br />within Streeter Canyon Fi11, the permittee will prepare and submit to tae <br />regulatory authority detailed engineering plans to abate any imminent or <br />manifested slope stability problem. Any appropriate remedial activity <br />shall commence immediately following the approval of the detailed <br />engineering plane by the regulatory authority. <br />Status: Resolved in the State Decision Document dated July 10, 1987, for <br />the permit renewal application approval. <br />Special Federal Condition: <br />Three sites (5MF401, 404, and 405) recorded and recommended for further <br />testing is 1975, require further investigation before Final eligibility e <br />determination can be made. OSMRE xi 11 field check these sites, update the <br />site(s) status, and make final eligibility recommendations. Until this <br />time, these site shall be protected from impacts by avoidance. Should one <br />or more of these sites be determined eligible for listing to the NRHP, the <br />operator shall confer with and obtain the approval of OSMRE and the <br />Colorado SHPO, concerning the development and implementation of mitigation <br />measures as appropriate. <br />Status: Resolved in the OSMRE letter to Colowyo Coal Company dated <br />November 19, 1985• <br />All of the special conditions attached to the Federal permit-mining plan <br />approval have been resolved. Therefore, the mining plan approval has no <br />special conditions. The standard conditions of the existing mining plan <br />approval are attached to this memorandum (Attachment A). <br />An "Experimental Practice" for the Stye=_ter Fi11 on the Colowyo mine was <br />approved by Colorado MLRD on August 26, 1982 and approved by OSMRE on <br />September 10, 1982 pursuant to 30 CFR 785.13. Subsequently, OSMRE approved <br />an amendment to the Colorado State regulatory program that allowed <br />alternative design standards for excess spoil fill. On August 28, 1986, <br />Colorado MLRD terminated ~he Streeter Fill "Experimental Practice" and <br />redesignated it as en excess spoil fill, designed and constructed using <br />"alternative design standards" pursuant to Rule 4.09.1(3)• All monitoring <br />requirements for the fill remained as originally approved to insure the <br />stability requirements of, Co lorado Rule 4.09 were met. The Federal <br />approval of the Experimental Practice was terminated when OSMRE approved <br />the Colorado State program amendment which allowed the spoil handling <br />practice. <br />
