<br />3. The South Dakota Department of Game, Fish and Pazks, in consultation with the <br />Department, may require additional surface water monitoring regimes, parameters, and <br />intervals to augment biological monitoring objectives for the closure period. <br />4. All baseline biological reports and data collected relevant to the Acid Rock Drainage <br />impact to the Spearfish Creek watershed, originating from the LAC Minerals mine site, <br />shall be included in the Mined Land Reclamation Permit Amendment to Mine Permit <br />Number 445. <br />5. When baseline fish tissue analysis results from the University of Missouri are received, <br />appropriate human health agencies, as agreed upon by the Department of Game, Fish and <br />Parks, shall be provided this data to determine if there are any human health risks <br />contingent to human consumption of sport fish species from Squaw Creek. <br />1. By May 1, 1994 LAC Minerals shall submit an updated hydrologic monitoring plan for <br />the closure period to the Department for approval, including all surface and groundwater <br />quality monitoring stations, springs and seeps, lysimeters, clay moisture content, <br />thermistors, and including all monitoring parameters, testing methods, quality <br />assurancelquality control, and sampling schedules. This plan shall include shallow <br />groundwater monitoring (up to 50 feet deep) in North, West and South Gulches. <br />2. All surface water and groundwater sampling data sheets shall be submitted to the <br />Department no latex than ten days after LAC Mmerals' receipt of the final data sheets from <br />the laboratory of a given sampling set. <br />3. Upon removal of waste rock from the South Waste Dump, LAC Minerals shall submit for <br />approval a monitoring plan to define the extent of contaminated shallow groundwater in <br />Spruce Gulch. 1n the event contamination persists after the removal of the acid generating <br />portiod of the South Waste Dump br if contaminated groundwater adversely affects surface <br />water, LAC Ivfinerals shall initiate appropriate mitigative actions. An annual assessment <br />of this issue will be made by the Department and LAC Minerals at the annual Performance <br />Monitoring meeting described in the Performance Monitoring section of these conditions. <br />4. LAC Minerals shall submit for approval a monitoring plan to define the extent of <br />contaminated groundwater in the vicinity of the pit. In the event contamination persists <br />after the cap is installed over the backfilled waste rock to the point where surface water <br />is impacted to an unacceptable level, LAC Ivfinerals shall initiate appropriate mitigative <br />actions. An annual assessment of this issue will be made by the Department and LAC <br />Minerals at the annual Performance Monitoring meeting described in the "Performance <br />Monitoring" section of these conditions. <br />5 <br />
