Brad Janes <br />Re: MLR File ik 81-207 Zemlock and Son, Inc.--Blue Pit <br />Dear Mr. Janes: <br />In response to your letter of December 8, 1981, I submit the following. <br />A motion was made and approved at the Barfield County Commissioners <br />meeting of 30 November, 1981 approving the special use permit for <br />this project with the following contingencies: <br />(a) The area designated as area 5 be omitted from the project and <br />that the southern boundry of the permit be delineated by a line 50 <br />feet north of the top of the slope along Highway 82. This line was <br />staked in the field and approved by County Commissioner Larry <br />Velasquez and assistant county planner Terry Bowman following <br />field inspection on 8 December. The line has been surveyed and <br />is reflected in the revisions on the enclosed revised drawings of. <br />the plan. (b) The second contingency is that access to the operation <br />be changed to the location shocm on the revised maps and that the <br />haul road from the operation be maintained in a dust free condition. <br />The net effects of these changes result in the following changes in <br />the plan. (a) No mining caill be done in the Area 5 and therefor <br />the Basin Ditch will not be disturbed and the proposed inverted <br />siphon is not needed (b) The total area of the requested t'[LR <br />permit is reduced. ~'he revised acreages are tabulated on .sheet 3/3. <br />(c) Part of the new haul road from the operation to the county <br />road is outside the permit area but still on the Jean Blue land. <br />Formal permission for the imnrovement and"use of this road i.s bein; <br />incorporated in the Blue-Zemlock agreement and conies of this <br />agreement as will as survey.and design data on the road will be <br />submitted to you as soon as it is available. <br />The following is in response to the items contained in your letter <br />of 8 December. <br />Item 1--It is anticipated that the reconstructionof the mined slopes <br />to 2:1 may consume the majority of the available excess material, <br />however, if additional material is found to be available, attempts <br />will be made to develop 3:1 slopes. <br />Item 2--The acreages of the mining phase areas are shown on the maps. <br />
