It was verified on November 2, 1993, that Mr. Ebberts has <br />not complied with that requirement. Also, he has not initiated any <br />contract with us for additional material from the pit. <br />Mr. Ebberts contends that because he holds State Permit M-80-038 he <br />controls the pit area. Therefore, he may have the attitude that he <br />does not have to honor the terms of the BLM contract. <br />Contrary to what several of Mr. Ebberts annual reports have stated, <br />nothing has been produced from the pit since late 1980 or early <br />1981. As noted in our letter to Mr. Ebberts, the contract <br />authorizing use of the site expired on February 3, 1982. In <br />addition, BLM has never initiated any document which would <br />authorize San Miguel County use of the site. <br />Since Mr. Ebberts has apparently not taken our letter seriously, we <br />re,•,,esr *_hat ., n,; take whatever action is appropriate under State <br />Permit M-80-038 and State regulations in an attempt to effect the <br />reclamation of the subject site. <br />Thank you for your prompt attention to this matter.
