SECTION IV -MIDTERM ADEQUACY QUESTIONS <br />Pursuant to 2.08.3, the Division has the following adequacy questions and/or comments. The <br />Division would appreciate a timely response in the form of a technical revision. Please submit a <br />technical revision addressing these comments by January 31, 2006. <br />Our key adequacy concerns regard performance bond requirements and the lack of sufficient <br />detail in the current Permit Application Package (PAP) to recalculate the bond liability estimate <br />for this midterm review, hydrologic balance including probable hydrologic consequences; <br />drainage and sediment control; and groundwater monitoring. The Division's adequacy questions <br />are listed below, and are organized by the pertinent sections of the Rules and Regulations of The <br />Colorado Mined Land Reclamation Board. <br />3.02 PERFORMANCE BOND REQUIREMENTS FOR SURFACE COAL MINING <br />AND RECLAMATION OPERATIONS <br />The Division is in the process of reviewing the reclamation cost estimate for the New Horizon <br />Mine. In order to complete this process, we need the following information. The request to <br />provide this information is supported by Rule 2.05, which outlines the minimum requirements <br />for operation and reclamation plans. <br />1. There does not appear to be a map that shows the 27.00 Road detour and reconstruction. <br />In order to estimate the costs of removing the detour and reconstructing the original <br />alignment, additional information is necessary. Please provide appropriate maps and <br />plans for the detour and road reconstruction, or indicate where any existing information <br />might be found in the approved PAP. <br />2. The permit application includes an agreement with Montrose County for mining near <br />Roads AA and 25.50, and was valid from 1988 to 2003. Is there an agreement with the <br />county for 27.00 and BB road detour, destruction, and restoration? Please provide a copy <br />of the current agreement, as well as information on specific reconstruction requirements <br />for the county roads. <br />3. Map 2.05.3(3)-3 in the permit application, showing typical road construction, includes <br />the caption, "width varies", for road width. Please provide updated cross sections for all <br />roads indicating the width of each road as it has been constructed. <br />4. The text (page 2.05.3-3) mentions that the "Sunshine Ranch Corner" intersection would <br />need to be restored. Please provide additional information, including maps and plans <br />showing the intersection prior to mining and the proposed reclamation configuration, and <br />any agreements with the county and/or landowners detailing reclamation requirements. <br />5. Please provide additional information for the restoration plans (mentioned on pages <br />2.05.3-4 and 2.05-.3-5) for access to the Enstrom, Wilcox, and Johnson properties (from <br />Morgan Road). <br />New Horizon Mine -6- November 23, 2005 <br />
