Stipulation 8 2/28/1989 4/15/1989 CW The operator will submit specific plans by April 15, <br /> 1989, in conjunction with the annual topsoil <br /> balance submittal, for salvage of seasonally <br /> saturated soils. These plans will include, at a <br /> minimum, timing and season of salvage <br /> operations, techniques used to ensure that soils <br /> will not be saturated at the time of salvage and <br /> any other applicable techniques that will ensure <br /> that the soils will remain suitable for use in <br /> reclamation as topsoil. <br />Stipulation 9 4/26/1993 8/1/1993 CW By August 1, 1993, Western Fuels will submit a <br /> permit revision modifying the old Peabody permit <br /> to reflect a reclamation only permit for the New <br /> Horizon Mine 1 area. All baseline and historical <br /> information shall be retained in this new permit. <br /> Upon completion of this permit, references to the <br /> 'Peabody permit' in the New Horizon Mine 2 <br /> permit shall be changed to reflect the reclamation <br /> only permit. <br />Stipulation 10 4/26/1993 5/12/1993 CW Eliminate the words'proposed monitoring plan' <br /> from the data and maps submitted by Greystone <br /> in the approved TR-12 and incorporate this <br /> information into the correct sections in the permit <br /> document. <br />Stipulation 11 4/26/1993 5/12/1993 CW Reincorporate the baseline information and maps <br /> from the old Peabody permit concerning'Nucla <br /> East' topsoil and prime farmland designation into <br /> the New Horizon Mine 2 permit document. <br />Stipulation 12 9119/1994 1/11/1995 CW The mine requires additional topsoil and has <br /> delineated an area for a suitable substitute <br /> material. TR-19 requires the analysis of this <br /> material prior to final approval. <br />Stipulation 13 10/31/1995 11128/1995 CW Revise the ground and surface water monitoring <br /> parameters, pages 2.04.7 33 and 34; 15-21 a, 15- <br /> 21b, and 15-22. <br />Stipulation 14 2/27/1996 5/3/1996 CW Section 2.05.4(2)d "topsoil redistribution" will be <br /> deleted and this matter will be resolved when TR- <br /> 28 is completed. <br />Stipulation 15 11/4/1996 2/28/1997 CW A revision needs to be submitted that shows how <br /> the 007 pond discharge of 2000-2400 mgll TDS <br /> can be used to augment Calamity Draw water if it <br /> is to be used at all.
