-z7- <br />XII. Fish aad Wildlife lcont' <br />for being impacted is the riparian zone adjacent to the river, which is used by <br />waterfowl. The plan does not specifically address protection or reestablishment <br />of this habitat. The following stipulation is necessary: <br />STIPULATION No. 10 <br />AS REQUIRED BY RULES 2.05.6(2)(a)(iii) AND 4.18(4)(e)AND (f), THE <br />APPLICANT WILL REVISE THE FISH AND WILDLIFE PLAN BY NO LATER THAN <br />JULY 1, 1983 TO EXPLAIN HOW THE RIPARIAN AREAS WILL BE PROTECTED <br />DURING MINING AND HOW THEY WILL BE RESTORED FOLLOWING MINING. A <br />SPECIFIC REVEGETATION PLAN WILL BE SUBMITTED FOR DISTURBED RIPARIAN <br />AREAS. <br />The application indicates that both bald and golden eagles inhabit the permit area. <br />In order to protect these and other raptors from electrocution, the applicant will <br />install perch guards on power poles as shown in figure 2.05.6(2)A of the application. <br />The applicant has indicated that a peregrine falcon aerie was discovered in July, 1977, <br />but the specific location and present status of the nest was not provided. <br />Communications with the Division of Wildlife indicated that the aerie is located to <br />the north of the permit area along the Colorado River and that the aerie was <br />inactive when first observed. A specific location could not be provided. Since <br />there are no plans to disturb any additional area at the mine, the peregrine falcon <br />aerie should not be further impacted. <br />Pursuant to Rule 2.07.6(2)(n) and on the basis of all available information, the <br />Division finds that the proposed operation will not effect the continued existence <br />of any threatened or endangered wildlife species. <br />The proposed operation is in compliance with the requirements of this section. <br />XIII. Prime Farmland (2.04.12, 2.06.6, 4.25) <br />The Division has made a negative determination on the presence of prime farmlands <br />based on information from the Soil Conservation Service and .in the permit appli- <br />cation in Volume I, Sections 2.04.9 and 2.04.22. <br />No Land within the permit area is irrigated, average annual precipitation is 9 inches, <br />and in many instances, the land slope exceeds 10X. In addition, a soil survey <br />of the area shows no soils designated as potential prime farmlands. <br />Pursuant to Rule 2.07.6(2)(k), the Division finds the proposed operation in compliance <br />with the requirements for Prime Farmlands. <br />XIV. Operations Description (2.05.2, 2.05.3(1), 2.05.3(2), 4.02) <br />The general description of the mining operations and facilities have been reviewed <br />by the Division for compliance with the Rules and Regulations. Concerns raised during <br />the Preliminary Adequacy Review were satisfactorily resolved by the applicant. The <br />general description of the mine operations can be found in Sections 2.05.2 and <br />2.05.3 of Volume I of the application. <br />Room and pillar and longwall mining methods are to be used in recovering the minable <br />coal reserves at the Cameo and Roadside mines. Major equipment will include <br />continuous miners, shuttle cars, roof bolters, shearers, hydraulic shields, and <br />belt conveyors. The anticipated annual production is 1,Z 00,000 tons of clean coal. <br />
