Long Division Director Re: Proposed Modification to NOI %-93-205-03 Addition of Alluvial Well and Surface Water Gauging 81te Dear Mr. Middleton: The Division received your application for a modification of coal exploration NOI X-93-205-03 on December 8, 1993. According to Rule 2.02.2(3), the Division must make a determination of the application's completeness. The Division has found that, according to the requirements of Rule 2.02.2(2), the. notice is incomplete. All items listed under this rule have been addressed except for the following: 1) A complete notice shall include a map, at a scale of 1:24,000, or larger if requested by the Division, of the exploration area (Rule 2.02.2(2)(c)). The map should include, at a minimum, the locations of the proposed alluvial well and surface water gauging site relative to the other boreholes included in the NOI, the locations of existing roads to be used for access to the sites, and the proposed path of "cross country" access. 2) A complete notice shall also include a narrative description of the methods to used to conduct coal explaoration and reclamation (Rule 2.02.2(2)(g)). TCC should submit details regarding the method for reclaiming the alluvial well borehole. 3) If the surface is owned by a person other than the person who intends to explore, a description of the basis upon which the person who will explore claims the right to enter such area for the purpose of conducting exploration and reclamation (Rule 2.02.2(2)(d)). TCC should identify the surface owner for the proposed sites and, if the surface owner is a party other than TCC, provide proof of
