The Regulatory Authority directs Bear Coal Company to submit, for revie~d <br />`- and approval by the Regulatory Authority, proposed loco*_iors and construction <br />specifications for the three monitoring stations to be installed upon the <br />backfilled material at the Bear No. 2 port al 'area. Immediately following the <br />completion of backfilling and grading of the Bear "Jo. 2 portal area, these <br />three monitoring stations shall be installed as specified and surveyed. Sur- <br />veying of these stations shall be repeated on a semi-annual basis far a period <br />of two years. Results of the surveying of these stations shall be submitted <br />to the Regulatory Authority within 30 days following completion of the semi- <br />annual survey. If monitoring of the backfilled area detects movement, which <br />the Regulatory Authority determines to represent an indication of imminent <br />hazard, the Bear Coal Company 'shall expeditiously develop and implement, fol- <br />lowing the Regulatory Authority's approval, a plan to mitigate that hazard and <br />to stablize the backfilled areas. <br />8. The Regulatory Authority directs Bear Coal Company to perform Proctor <br />testing to determine the moisture-density relations of the materials to be <br />utilized in backfilling the Bear No. 1 and No. 2 mine portal areas and submit <br />the result to the Regulatory Authority. In conformance with the recommenda- <br />tions of Rocky Mountain Geotechnical, Inc., the materials shall be placed and <br />compacted to achieve 95% of the maximum proctor density, as determined in <br />accordance with ASTM standard TEST D-698. Further, Bear Coal Company shall <br />submit a certified inspection report to verify completion of backfilling and <br />grading of the Bear No. 1 and No. 2 mine portal areas in conformance with the <br />approved plan. This certified report shall be prepared .by a qualified regis- <br />tered professional engineer or professional geologist. The report shall be <br />(~ submitted to the Regulatory Authority within 60 days of the completion of <br />backfilling and grading. <br />9. The Regulatory Authority directs Bear Coal Company to submit a detailed <br />engineering plan for the pot±al access road and portal facilities at the Bear <br />No. 3 Mine, for review and approval by the Regulatory Authority, no later than <br />30 days following approval of the permanent program permit. This detailed <br />engineering plan shall include road and portal crass-sections, road and portal <br />plan and grade design drawings, and detailed engineering design drawings for <br />all retaining structures and drainage facilities. No additional disturbance <br />shall occur in the area of the portal access road or portal facilities until <br />these detailed engineering plans have been reviewed and approved by the Regu- <br />latory Authority. <br />10. The Regulatory Authority directs Bear Coal Company to submit the locations <br />and construction specifications for monitoring facilities designed to monitor <br />the stability of the portal access road and portal facilities at the Bear No. <br />3 Mine. These monitoring facilities shall consist of appropriately located <br />tilt metering and location monitoring facilities. These facilities shall be <br />designed to monitor both the operational and reclaimed configurations of the <br />portal access road and portal facilities. Installation of these monitoring <br />facilities shall occur as immediately following constuction in the portal <br />access road and portal facility areas as is feasible. 1•fonitoring shall com- <br />mence immediately following installation and continue on a semi-annual basis <br />until two years following completion of the reclamation of the portal access <br />road and portal facility area. Results of the semi-annual monitoring shall be <br />/"'~ submitted to the Regulatory Authority within 30 days following completion of <br />that semi-annual monitoring.
