Permit Number CO-0068, ( ) Page 1 of 7 UNITED STATES DEPARTMENT OF THE INTERIOR OFFICE OF SURFACE MIMING This permit is issued far the United States of America through the Office of Surface Mining to Bear Coal Company the sublessee of Federal coal lease: D-052501, D-044569, and C-0117192. This permit is not valid until a performance bond is filed with OSM in the amount of 556,000.00 payable to the Office of Surface Mining and State of Colorado, and until the Office of Surface Mining has received a copy of this permit signed and dated by the permittee. Sec. 1 STATUTES AND REGULATIONS - This permit is issued pursuant and sub- ject to the terms and provisions of the Surface Mining Control and Reclamation Act of 1977, 30 U.S.C. 1201 et seq., hereafter referred to as the Act, and the terms and conditions of the Federal coal lease issued pursuant to the Mineral Leasing Act of February 15, 1920, as amended, 30 U.S.C. 181-287, the Federal Coal Leasing Amendments Act of 1976, as amended, 90 Stat. 1083-1092, and in the case of any acquired lands, the t4ineral leasing Act far Acquired Lands of September 1, 1947, as amended, 30 U.S.C. 351-359 et sea. This permit is also subject to all applicable regulations of the Secretary of the Interior (including, but not limited to, 30 CFR Part 211 and Chapter VII and 43 CFR Group 3400), and to all regula- ~"l tions of the Secretary of Energy promulgated pursuant to Secticn 302 of the Department of Energy Organization Act of 1977, 42 U.S.C. 7152, which are now in force or (except as expressly limited_ herein) hereafter in force, and all such regulations are made a part of underground activities and surface coal mining operations. Sec. 2 This permit authorizes the permittee to conduct surface coal mining " and reclamation operations on the Federal lands within the permit area situated in the State of Colorado, County of Gunnison, con- taining approximately 287 acres for the Bear 113 mining operation and for the reclamation of Bear ~1 and ~2, subject to the condi- tions of the lease, the approved mining and reclamation plan, the terms of this permit, and applicable laws and regulations. The lands included.in this permit are described as follows: Bear R1 + R2 Township 13 South, Range 90 41est, 6th P.M. Section 9: Lots 1, 2, 3, and S1/4 S:J1/4 $W1/4 or that part of the S4J1/4 SW1/4 South of the tlorth Fork of the Gunnison River Section 16: All Section 21: SW1/4 Ntdl/4, N1/2 ..1/2 containing 1,000 acres cf land, more or less Section 20: NE1/4, E1/2 N4l1/4 Section 17: SE1/4 N4J1/4, E1J4 SW1/4 containing 360 acres o` land, more or less ~~ 6i`i 169 ~~ .. ~
