5. Flood Control Berm. The flood control berm was approved by <br /> Boulder County under a special permit issued on February 20 , <br /> 1980 , over two years ago. During the course of the review <br /> of the permit proposal (from September 1979 to February 1980) , <br /> the county and all other interested parties agreed with the <br /> assessment made by Flatiron' s water consultants that the berm <br /> created no measurable impact on downstream landowners . <br /> 6 . Boulder County Stipulations . Flatiron intends to comply with <br /> all its legal obligations to local , state and federal governments. <br /> 7. Alternate Reclamation Plan To Meet Boulder County Permitting <br /> Process . Because Flatiron has applied for a permit for the <br /> entTire 168. 5 acre site and because Boulder County stated that <br /> the "basic conceptual layouts of the Alternate Excavation Plan <br /> Map and Reclamation Plan Map for the entire property are generally <br /> acceptable" , Flatiron suggests that an alternate reclamation <br /> plan map which would cover mining of only stages 1 and 2 be <br /> prepared only in the event that Boulder County ultimately limits <br /> excavation to these two stages . <br /> 8 . Seed Mix. You expressed concern that the seed mix for Deepe <br /> be weighted more heavily for low-growing grasses . The mix <br /> suggested in the permit is : <br /> Species Height <br /> Big bluestem tall <br /> Blue grama low (8-10") <br /> Buffalo grass low (4-6") <br /> Western wheatgrass medium (12-15") <br /> Slender wheatgrass medium (12-15") / �\ <br /> Alkali sacaton low (8-10") I ) <br /> White clover low (4-6") <br /> This seed mix is now weighted toward low-growing perennials . <br /> In addition, the Deepe site is at a considerable distance from <br /> the homes in the 'City of Boulder. Flatiron has agreed to keep <br /> low-growing grasses in a fire-break area adjacent to the dozen <br /> townhouse homes in South Creek that border Flatiron property. <br /> In general, moisture characteristics determine vegetation <br /> heights. A seed mix with a variety of plant heights allows <br /> each area on the site to , in a sense, select the grasses most <br /> suitable at each location. <br /> We are willing to adjust the seed mix in whatever direction is <br /> most suitable for excellent reclamation of the Deepe Farm site. <br /> If you prefer that we add other low-growing grasses , please let <br /> me know. <br /> 9 . Colorado Division of Water Resources. No comment yet received. <br /> 10. Colorado Division of Wildlife. No comment required. <br />
