any adverse impacts which may occur to the pipeline due to the proppsed <br />mining operations. Potential solutions which are presently being - <br />evaluated include relocation of the pipeline, in-place activities <br />necessary to protect the pipeline if left in place and redesigning the <br />mine plans. Until a decision has been made by EEC and approved by the <br />CMLRD, EEC commits to not conducting full extraction mining operations <br />within 100 feet (horizontal) of the existing pipeline. In the five (5) <br />year permit term of this application, this would be applicable only to <br />longwall panel No. 1 of Mine No. 6 ('E' Coal). The depth from surface to <br />bottom of the 'E' Seam at that location is 200 feet. The angle of draw <br />is calculated to be 19 degrees. 100 feet horizontal distance is a <br />conservative figure to assure na subsidence affects, given the above <br />data." <br />As observed earlier, here above, each of the other critical structures or <br />renewable resource lands referenced is planned to be subsided during the <br />life-of-mine operations of the Eagle No. 6 Mine. Before a permit can be <br />approved which includes planned subsidence of any of these critical features, <br />the applicant will be required to demonstrate, to the Division's satisfaction, <br />that no material damage will be sustained. <br />D. Subsidence Monitoring Program <br />Empire Energy Corporation proposes to conduct a subsidence monitoring program <br />at the Eagle Mine complex. The applicant has performed subsidence monitoring <br />at the Eagle Mines throughout the previous permit period. However, the the <br />applicant proposes to use a combination of existing and new subsidence <br />monitoring points, as well as a program of visual observations to continue <br />subsidence monitoring. <br />The Empire Energy Corporation's monitoring plan depicts monument installations <br />on Map 31 of the amended permit application. Existing monuments are shown <br />above panels of the 3rd-East area of the Eagle No, 5 mine (labeled as Monument <br />Series A, B, C and D). Monuments are also indicated above a longwall panel of <br />the Eagle No. 5 mine (labeled as Monument Series K, 0, P, Q, R and S). <br />Monitoring and observation programs will commence one month prior to the time <br />mining-induced surface subsidence, based on a projected angle of draw of 19 <br />degrees, could impact each monitoring location. <br />New subsidence monitoring points will be established at the four corners of <br />the two private residences, as well as along State Highway 13. Locations for <br />monitoring points along the highway will be established following approval of <br />the locations by the Division, as mining approaches the highway.=: <br />Monitoring of monuments shall be performed at least quarterly, commencing one <br />month prior to initiation of mining beneath any established monument or <br />structure. In order to ensure that the monuments and structure points are <br />properly installed, they will be surveyed at least twice prior,-,#o the <br />initiation of subsidence. Results will be submitted to the Division <br />semi-annually in report form. The subsidence monitoring program will continue <br />unt11 the results indicate that: 1) subsidence has not occurred, 2) subsidence <br />has ceased, ar 3) subsidence that has occurred has not caused any material <br />damage, and the Division concurs with the conclusions, in writing. <br />-65- <br />
