It is determined that rangeland/wildlife habitat and cropland meet the „ <br />requirements of Rule 4.16. These land uses are compatible with surrounding. <br />areas. <br />This section is in compliance for Eagle No. 5, 5A and 6 Mines. <br />Pursuant to Rule 2.07.6(2)(1), the Division hereby approves the proposed <br />post-mining land use for the Eagle No. 5, 5A and 6 Mines. <br />III. Cultural and Historic Resources - Rules 2.04.4 2.05.6(4) and 2.07,6(2)(e) <br />Rule 2.04.4 requires a description of the cultural and historic resources <br />listed on the National Register of Historic places and known archaeological <br />features within ail areas proposed for surface activities or probable <br />subsidence over the life of the mine. These resources and features are <br />described in Section 2.04,4 and Exhibit 6 of the permit revision application. <br />A letter from Arthur C. Townsend, State Historic Preservation Office of the <br />Colorado Historical Society (January 7, 1982) to Richard Dawes, OSM Western <br />Technical Center, Denver, Colorado, stated that "there will be no effect on <br />cultural resources for the above mining operation (Empire Energy Corporation <br />Empire Mine). <br />No new surface disturbances are proposed in the proposed permit revision, <br />therefore, the letter from the State Historic Preservation Office is sti1T <br />valid. In addition, Empire Energy Corporation has committed to contact either <br />the Regional Director or the District Mining Supervisor of the Bureau of Land <br />Management if any archaeological or cultural resources are discovered during <br />Empire Energy's mining activities. <br />Pursuant to Rule 2.07,6(2)(e), the Division finds that the mining operation <br />will not adversely affect any publicly owned park or place listed on the <br />National Register of Historic Places. <br />The application is in compliance with the requirements of this section for <br />Eagle Mine No. 5, 5A and No. 6. <br />IV. Climatological Information and Air Resources - R <br />The baseline climatological information is found in Section 2.04.8 (pages <br />2,04.8-1 through 2,04.8-9) of the permit application. An adequate air <br />pollution control plan is provided by the applicant on page 2,05,6-1. Permits <br />from the Colorado Air Pollution Control Division are found in Exhibit 2. <br />Empire Energy Corporation has provided all of the information required by <br />these Regulations. <br />The application is in compliance with the requirements of this-section for <br />Eagle Mines No. 5, 5A and 5. <br />-14- <br />
