IV. Review Process <br />• The DMG reviewed the PAP under the Colorado State program, the Federal lands <br />program (30 CFR Chapter Vll, Subchapter D), and the Colorado cooperative agreement <br />(30 CFR §30 CFR 906.30). Pursuant to the Colorado State program and the cooperative <br />agreement, DMG approved the permit revision on June 28, 2000. <br />The Office of Surface Mining Reclamation and Enforcement (OSM) has consulted with <br />other Federal agencies for compliance with the requirements of applicable Federal laws. <br />Their comments and/or concurrences aze included in the decision document. <br />The Bureau of Land Management (BLM) reviewed the resource recovery and <br />protection plan for compliance with the Mineral Leasing Act of 1920, as <br />amended, and 43 CFR Part 3480. The BLM recommended approval of the <br />mining plan modification in a memorandum dated July 13, 2000. <br />OSM's independent review May 16, 2000, of the effects of the proposed action on <br />threatened and endangered species indicates that no adverse effects will occur to <br />any threatened or endangered species as a result of the proposed action. This <br />determination is based upon conversations with the U.S. Fish and Wildlife Service <br />(USFWS) regazding the effects of the proposed action and previous Section 7 <br />consultations for the mine. The USFWS and the OSM agreed that the <br />development ofspecies-specific protective measures was not necessary at this <br />• time. <br />The State Historic Preservation Officer concurred with the proposed mining plan <br />modification in a letter dated June 16, 2000. <br />The proposed azea of mining plan approval is not unsuitable for mining in accordance <br />with Section 522(b) of SMCRA. <br />The mining plan modification azea is not on any Federal lands within the boundaries of <br />any national forest. <br />I have determined that approval of this mining plan modification will not have a <br />significant impact on the quality of the human environment. The environmental analysis <br />prepared by BLM and OSM for the Environmental Assessment #CO-016-95-020, noted <br />in the Finding of No Significant Impact (FONSI), describe the impacts that may result <br />from approval of this mining plan modification and its alternatives. The FONSI and <br />supporting environmental analyses are included in this decision document. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special stipulations to the mining plan approval. <br /> <br />
