road, approximately 100 feet in length, splits off of Routt County <br />Road 29 to provide access to the facilities area. This same road is used <br />to haul coal from the area. The road was constructed in 1976 along with <br />the other mine facilities and no problems have been observed. <br />The only other road on site is an access road to the portal bench from <br />Routt County Road 29. Again, no problems have been noted with this road. <br />The operation is in compliance with the requirements of this section. <br />XXI. Bonding - Rules 2,05,3(2)(b) and 3.0 <br />Information pertaining to bonding is presented on pages 185-185.7 of the <br />permit application and in the Permit Renewal No. 1 application file. <br />A review of the file indicates that the Division is holding Certificate <br />of Deposit No. 1273 from the First National Bank of Steamboat Springs for <br />E37,500.00 for the first five-year permit term. <br />With the submittal of the Permit Renewal No. 1 application, the <br />worst-case reclamation costs were recalculated by the Division. After an <br />exchange of correspondence and an on-site meeting on May 3, 1988, a final <br />worst-case reclamation cost of $82,420.00 was calculated. <br />The net additional bond coverage required to be posted as part of the <br />permit renewal approval (E44,920.00) is calculated as the difference <br />between the revised bond total (E82,420,00) and the previous bond total <br />held during the first five-year permit (537,500.00). <br />The E44,920.00 required additional bond coverage for the permit renewal <br />must be submitted to and accepted by the Division as part of this permit <br />renewal application, Ks such, the following stipulation is imposed. <br />Stipulation No. 1: <br />A PERFORMANCE BOND FOR THE APEX N0. 2 MINE, IN A TOTAL AMOUNT OF <br />X82,420.00, PAYABLE TO THE STATE OF COLORADO AND THE UNITED STATES <br />OF AMERICA, MUST BE FILED WITH THE DIVISION WITHIN 30 DAYS OF THE <br />DECISION BECOMING FINAL. <br />With the acceptance of this stipulation, the operation is in compliance <br />with the requirements of this section. <br />XXII.
