3. The applicant has made a demonstration, based on site specific precipitation rates, percent <br />of grade, and soil properties, that use of alternative specifications for culvert sizing will not <br />result in increased erosion. The Division therefore proposes to approve the use of the <br />alternative specifications for the culverts identified on Map 5-2 (4.03.1(4)(e)(vi)). <br />II. Hydrologic Balance -Rule 4.OS <br />A. Stream Channel Diversions <br />1. The Division proposes to approve a permanent diversion. This diversion is consistent with <br />applicable state law, will not diminish downstream water rights and meets the requirements <br />of Rule 4.05.4 (4.05.4(4)). <br />B. Acid-forming and Toxic-1:orming Spoil <br />1. The Division proposes to approve temporary storage of acid- and toxic-forming spoil or <br />underground development waste for more than 30 days. This decision is based on a <br />finding that burial or treatment of these materials within 30 days is not feasible and the <br />delay will not result in any material risk of water pollution or other environmental damage <br />(4.05.8(3)). <br />C. Surface and Ground Water Monitoring <br />1. The applicant will conduct monitoring of ground water in a manner approved by the <br />Division. The ground water monitoring plan is as follows: (4.05.13(1)) <br />a. The baseline data results are discussed and tabulated in appendix 4-3 of the permit <br />application. <br />b. Currently there aze three wells that aze being monitored at the Cazbon Junction Mine. <br />These wells azE; 17B, 94-1, and 95-1. These wells will be semi-annually for full suite <br />water analysis and water levels. <br />2. The applicant will conduct monitoring of surface water in a manner approved by the <br />Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv) and includes the <br />following: (4.05.13(2)). <br />a. Baseline data and results are included in Appendix 4-3 of the permit. <br />b. Three springs, Nos. 1, 3, and 4, will be monitored semi-annually for full suite water <br />quality parameters. The springs will also be monitored semi-annually for flow, <br />temperature, pH, and conductivity. <br />c. NPDES sites (sediment pond outlets) will have monthly maintenance, service, flow <br />measurements, field parameters, and quarterly full suite water quality samples. <br />12 <br />
