Nolen, MD, MPII <br />(lL'cNRC DCCl1Or <br />Certified ~P 162 829 874 <br />Return Receipt <br />The Air Pollution Control Division received complaints regarding <br />fugitive coal dust emissions coming from Basin Resources haul <br />trucks on Highway 12 in Las Animas County. I spoke with Ralph <br />Lopez, mine environmental coordinator, regarding the allegations by <br />phone earlier today. Mr. Lopez said that the coal truck beds have <br />wind guards which help control particulate spillage and that Mike <br />Ossola, Las Animas County planner, observed the haul trucks <br />yesterday and saw no fugitive emissions from the hauling operation. <br />Mr. Lopez also said that a faulty dumping mechanism on one of the <br />trucks a month ago had caused coal spillage along Highway 12 and <br />the hauling contractor had attempted to clean it up by sweeping. <br />It's possible that the spillage still lingers along the side of the <br />highway and is entrained by passing vehicles. Please check the <br />spill area and clean up any residual coal dust. <br />Please refer to the Fugitive Particulate Emissions Control Plan <br />in Emission Permit 84LA074F (2) issued Basin Resources which <br />states: <br />3. Haul truck loads of refuse shall be watered as <br />necessary to remain viable as a fugitive emission control <br />measure. Load size shall be limited to prevent spillage. <br />4. Entryways of unpaved roads onto paved roads shall be <br />graveled to minimize dirt carryover onto paved surfaces. <br />Dirt and refuse carryover onto paved surfaces shall be <br />cleaned up daily by washing off with water at least once <br />daily and 5 times per week, or as necessary to remain <br />viable as a fugitive emission control measure. <br />Mr. Lopez further stated that hauling is done by a subcontractor of <br />Basin Resources and it was their responsibility to clean up the <br />spill and control emissions.
