<br />E. POWDER MAGAZINES <br />(1) To the extent permissible under regulations of. the <br />governmental agencies having jurisdiction, the applicant <br />shall locate the powder magazines at minimum separation <br />distances as provided by such regulations and shall relocate <br />the westerly powder magazine to a point at the minimum <br />permissible distance from the easterly powder magazine, <br />wnicn is anticipated as being not greater than forty-one <br />feet (41'). Any temporary powder magazines may exceed the <br />above-referenced separation distance. <br />F. DUST MITIGATION <br />(1) The applicant, to extent reasonably feasible, shall arevent <br />the emanation of dust and otner airborne particulates Erom <br />the project site. without limiting the foregoing, the <br />applicant agrees to nave all loads of coal coverea ~.~itr. <br />tarps or other acceptaole metnods to prevent the <br />dissemination of coal dust along truck routes. <br />S. That prior to hauling any coal off-site, the proposed haul road <br />be designed based upon a pavement thickness design performed by <br />an engineer qualified to perform such a study. Further, that the <br />Board of County Commissioners review the document ane require the <br />applicant ouild the haul road in accordance with the <br />specifications contained in the report prior to hauling coal. <br />6. That the test mine not exceed 960,700 tons of coal per year or an <br />average of 54 round trip trucK trips per day on a monthly oasis. <br />Further, that all hauling activity will be limited to daylight <br />hours. <br />Dated this 30th day of September A.D. 1955 <br />ATTEST: GARFIELD COUNTY BOARD OF COMMISSIONERS <br />GARFIELD.
