In addition to the displacement soil creep has also occurred on
isolated areas. The operator has been diligent in repairing
the cracks and slumps, however, they seem to be occurring
frequently and the Division is concerned about the cause of the
slumps. It has been discussed in the field that perhaps an
initial geotechnical investigation should be conducted to
determine exactly what the cause is for the continuing settling
problem. The Division is therefore requesting that a revision
be submitted that clearly defines a plan to investigate exactly
what the cause of the slumping is. Once this is approved and
the investigation is completed, the Division may require that
steps be taken to control the problem if it is determined that
it can be remediated.

4) Are the surface and mineral owners the same as presented in the
permit application? If not, please provide an updated page of
any new owners and their written consent to enter property.
5) Please provide maps (or indicate where they can be found) that
include all boundaries of lands and names of present owners of
records of those lands, both surface and subsurface, included
in or contiguous to the permit area in which the operator has
a right to enter. The Division was unable to locate these
maps.
6) Please update the acreage that Hayden Gulch is currently liable
for with respect to reclamation liability.
7) Rule 2.04.7(1) requires the operator to provide the depth and
extent of the potentiometric surface of each aquifer above ,
within, and the first aquifer below the mined coal seam. This
information does not appear to be in the permit. Please
provide the required discussion or indicate where it can be
found in the permit.
8) Rule 2.04.7(1) requires the operator to provide information on
the seasonal variations in groundwater quantity and quality.
Although baseline data have been provided, a discussion of
seasonal variations does not appear to have been provided.

and yields of wells within the permit area. Although the
